【摘要】 随着全面依法治国的不断推进,依法行政在城管执法行为问题上显得非常重要。依法行政是城管执法行为的重要支撑,在实现全面依法治国的进程中发挥着重要的作用。我国城管执法存在的最突出的问题就是暴力执法问题,暴力执法行为屡屡在街头上演,对依法行政造成严重地阻碍,严重影响了中国逐步实现法治化的进程。暴力执法也只是城管执法行为问题中的一个方面,导致城管暴力执法的原因也很复杂,城管执法权力的最初来源是《行政处罚法》中“相对集中处罚权”的设立,其目的在于使行政执法行为更为高效便捷,其出发点是“以人为本”,但在实施多年以来,却一直问题不断,城管暴力执法一直都反映执法行为中存在的问题。近年来,依法行政不断推进,但是依旧没有杜绝暴力执法行为的发生,意味着我们对城管执法队伍的暴力执法行为的根源还缺乏深刻的认识,依法行政依旧要继续推进,城管执法队伍依旧需要找到有效地治理途径。本文由五个部分构成,第一部分是绪论,主要说明论文的研究背景,概括论文的国内外研究现状,并介绍了本文的研究方法和思路。第二部分是核心概念与理论基础,根据论文提出相应的基础概念并释义,提出研究本文的基础理论。第三部分阐述了北京城管执法队伍的概况,以北京城管执法队伍为典型,探讨城管执法的特征,并对具体案例做出分析。第四部分着重阐述了城管暴力执法的问题所在,并对存在的问题结合当前的城管执法队伍现状以及具体案例做出原因分析。第五部分是笔者对城管暴力执法问题做出的对策建议,主要针对第四部分提出的问题提出针对性的建议,比如完善城管部门法律体系,限制城管的自由裁量权,推进公众参与机制,建立城管权力与责任清单制度,明确刑事司法和行政执法的界限,建立个人追责制度。更多还原

【Abstract】 With the continuous advancement of the law-based governance of the country,the law-based administration is very important in the problem of urban management law enforcement.Administration by law is an important support for urban management law enforcement and plays an important role in the process of realizing the rule of law in an all-round way.The most prominent problem of urban management law enforcement in China is the problem of violent law enforcement.Violent law enforcement ACTS are frequently performed in the streets,which cause great obstacles to the administration according to law and seriously affect the process of gradually realizing the rule of law in China.Violence law enforcement is just one aspect of the urban management law enforcement behavior problems,the causes of urban management law enforcement of violence is very complex,the original source of the urban management enforcement power is the law on administrative punishments,the establishment of "relatively concentrated punishment",its aim is to efficiently carry out administrative law enforcement behavior,its starting point is "people-oriented",but in the implementation for many years,has been problem,urban management law enforcement of violence has been reflected the problems existing in the law enforcement behavior.In recent years,law-based administration has been promoted continuously,but the occurrence of violent law enforcement behaviors has not been eradicated,which means that we still lack a deep understanding of the root causes of violent law enforcement behaviors of urban management law enforcement teams.Law-based administration still needs to be promoted,and urban management law enforcement teams still need to find effective governance approaches.This paper is composed of five parts.The first part is the introduction,which mainly explains the research background,summarizes the research status of this paper at home and abroad,and introduces the research methods and ideas of this paper.The second part is the core concept and theoretical basis,according to the thesis put forward the corresponding basic concept and interpretation,put forward the research of the basic theory.The third part expounds the general situation of the law enforcement team of Beijing urban management,taking the law enforcement team of Beijing urban management as a typical example,discusses the characteristics of the law enforcement of Beijing urban management,and makes an analysis of specific cases.The fourth part focuses on the problems of urban management violence law enforcement,and the existing problems combined with the current situation of urban management law enforcement team and specific cases to make a cause analysis.The fifth part is the countermeasures and Suggestions to the problems of urban management law enforcement of violence,mainly aiming at the problem of the fourth part puts forward pertinent Suggestions,such as legal system,improve the urban management department limit at the discretion of the urban management,promote the public participation mechanism,build system of urban management powers and duties list,clear the limits of criminal justice and administrative law enforcement,establish personal accountability system.更多还原
