【摘要】 随着社会的不断进步和发展,国家越来越重视知识产权的作用,企业和个人层面的知识产权意识也越来越强。专利是知识产权的重要组成部分,专利质量的高低决定知识产权战略的实施效果。对于企业来说,知识产权是企业的无形资产,是企业的核心竞争力。专利又是企业核心技术最重要的载体,是企业潜在市场价值的体现。但是事物的发展是一个渐进的、缓慢上升的过程。新生事物是要经历多种要素相互磨合的阶段才能不断发展和完善。专利制度在中国的产生和发展正好处于中国经济发展的新时期,各种要素井喷式出现,使得专利在中国发展速度相对于其他国家过于迅猛。人们对于新生事物的接受、吸收和消化是需要时间的,所以“问题专利”、“垃圾专利”的出现是不可避免的。如何区分专利的好坏,是当前急需解决的问题。为了更好地评价专利质量,学者们开始进行专利质量相关研究。随着专利质量相关研究的深入,专利质量指标和构建指标体系的相关研究也不断发展。专利指标的研究相对于构建指标体系的研究更加深入、成熟。学者们已经定义出许多应用广泛、实用性强的专利指标。但是在构建专利质量指标体系的研究方面还存在许多问题。本文希望从专利质量的定义出发,逐步筛选指标,最终构建一个兼顾实用性和可行性的专利质量指标体系。本文在研究和总结前人关于质量指标与指标体系的研究基础上,结合本文给出的关于专利质量的定义。构建了以专利维持、专利范围、专利技术、市场价值为一级指标的指标体系。以通信设备制造业领域1321个专利样本为一个“系统”,用逻辑回归分析方法确定指标权重,并且验证各个指标的显著性。最后用第二十届、二十一届中国专利奖获奖项目中,涉及通信设备制造业领域的专利的数据进行指标体系有效性验证。最终证明所构建专利质量指标体系有效。用构建好的指标体系进行实证研究,分析2019年在中国手机销量前五名企业的专利质量情况,并提出相关政策建议。更多还原

【Abstract】 With the continuous progress and development of society,the state attaches more and more importance to the role of intellectual property,and the awareness of intellectual property at the level of enterprises and individuals is also growing.Patent is an important part of intellectual property.The quality of patent determines the implementation effect of intellectual property strategy.For enterprises,intellectual property is their intangible assets and core competitiveness.Patent is the most important carrier of enterprise core technology and the embodiment of enterprise potential market value.But the development of things is a gradual and slowly rising process.New things need to go through the stage of multiple elements running in each other to develop and improve continuously.The emergence and development of patent system in China is just in the new era of China’s economic development.The blowout of various factors makes the development of patent in China too fast compared with other countries.It takes time for people to accept,absorb and digest new things,so the emergence of "problem patent" and "waste patent" is inevitable.How to distinguish the quality of patents is an urgent problem.In order to better evaluate the patent quality,scholars began to study the patent quality.With the deepening of the research on patent quality,the research on patent quality index and the construction of index system is also developing.The research of patent index is more indepth and mature than that of constructing index system.Scholars have defined many patent indicators with wide application and strong practicability.However,there are still many problems in the research of patent quality index system.In this paper,we hope to start from the definition of patent quality,gradually select indicators,and finally build a patent quality indicator system that combines practicability and feasibility.Based on the research and summary of previous studies on quality indicators and index system,this paper combines the definition of patent quality.The index system with patent maintenance,patent scope,patent technology and market value as the first level index is established.Using 1321 patent samples in the field of communication equipment manufacturing as a "system",the index weight is determined by the method of logical regression analysis,and the significance of each index is verified.Finally,the validity of the index system is verified by using the patent index data in the field of communication equipment manufacturing in the 20 th and 21 st China patent awards.Finally,the patent quality index system is proved to be effective.This paper analyzes the patent quality of the top five mobile phone companies in China in2019.and puts forward relevant policy recommendations.更多还原
