【摘要】 近年来,随着互联网的高速发展和移动社交平台的快速崛起,短视频作为一种新型的传播方式应运而生。凭借着内容丰富、时间短、形式多样、制作门槛低等特点,短视频这一新型传播方式迎合了当下社会快节奏的生活需求,迅速吸引了大量流量,形成了稳定的用户群体。然而,短视频蓬勃发展的背后,各种侵权现象屡屡发生,尤其以混剪视频为代表的新型拼接视频种类层出不穷,而此类视频是否构成合理使用或侵权,业内尚无统一观点。我国著作权法中现有的三步检验法过于粗糙,往往在司法实践中难以运用,导致经常发生“同案不同判”的问题,客观上损害了司法的公信力。混剪类视频作为一种新型的拼接视频,种类繁多,本文将对其进行初步的类型化分析,将形式各异的剪辑视频划分为“评论介绍型”、“恶搞戏仿型”以及“其他再现型”三类,同时建议引入美国的转换性使用规则进行解释分析,主张将不同种类混剪视频分别讨论,将“评论介绍型”、“恶搞戏仿型”通过转换性使用规则纳入到合理使用范畴,而对于不能认定为合理使用的视频类型,建议增加法定许可种类,建立版权共享和补偿金制度,以此来实现著作权保护和表达自由利益之间的平衡。本文正文共四个部分,由四章组成,主要内容如下:第一部分,首先对混剪视频的概念、特点和制作过程进行了一个简单介绍,并同时分析了目前混剪视频行业的发展现状。将现有主要的混剪视频进行了类型化的分析,指出了目前混剪视频发展中存在原创作者和二次创作者的利益冲突问题、相关司法裁判不一和行政监管片面打击问题。第二部分,以第一部分所得的论述作为基础,进一步提出了我国目前合理使用制度的缺陷,提出了合理使用制度在混剪视频领域的适用困境,并且从立法模式上和具体条款上分别进行了分析,得出目前混剪视频乱象的部分缘由是现行法律相关漏洞和缺陷所致。第三部分,建议引入美国的转换性使用规则以完善我国的合理使用制度。首先介绍了转换性使用规则的起源和发展,然后分析转换性使用规则可以为完善我国合理使用制度所带来的益处,最后分析转换性使用规则引入我国的可行性。第四部分,提出完善我国现有合理使用制度,引入转换性使用规则,明确转换性规则的使用标准,建议增加一般性规则,对于上述类型化分析的视频分类分情况处理,能够通过转换性使用的纳入合理使用,不能通过的混剪视频类型建议增加法定许可种类,引入共享版权和补偿金制度,以达到著作权保护和自由创作之间的双赢。更多还原

【Abstract】 In recent years,with the rapid development of the Internet and the rapid rise of mobile social platforms,short video emerged as a new mode of communication.With the characteristics of rich content,short time,various forms and low production threshold,the new communication mode of short video caters to the needs of the fast-paced life of the present society,quickly attracts a large amount of traffic and forms a stable user group.However,behind the booming development of short video,various infringement phenomena occur frequently,especially the new type of spliced video represented by mixed clip video emerges in an endless stream,and whether such video constitutes fair use or infringement,there is no unified view in the industry.However,the existing three-step inspection law in China’s copyright law is too rough and difficult to be applied in judicial practice,which often leads to the problem of "different judgments in the same case",which objectively damages the judicial credibility.Mixed cut class video as a new type of splicing video,sort is various,this article will carry on the preliminary analysis of the typing,will form the different editing video is divided into "comment","parody" and "other reappearance type" three types,also suggested that the introduction of the United States transformation using the theory to analyze interpretation rules,advocated to mix different kinds cut video discussed respectively,For video types that cannot be recognized as fair use,it is suggested to increase the types of legal license and establish the system of copyright sharing and compensation,so as to achieve the balance between copyright protection and the interests of freedom of expression.The main body of this paper consists of four chapters.The main content is as follows:In the first part,the concept,characteristics and production process of mixed video are briefly introduced,and the development status of the mixed video industry is analyzed.This paper makes a categorical analysis of the main existing mixed-cut videos,and points out that there are some problems in the development of mixed-cut videos,such as the conflict of interest between the original author and the second creator,the inconsistency of relevant judicial judgment and the one-sided crackdown of administrative supervision.The second part,in the first part of the paper as the foundation,further put forward the our country at present the defects of the system of fair use,put forward the reasonable use system applied in the field of mixed cut video dilemma,and separately from the legislative mode and specific terms and conditions are analyzed,it is concluded that the mixed cut video disorderly as part of the reason is caused by current law loopholes and defects.In the third part,it is suggested to introduce the American transformational use rules to improve the fair use system in China.This paper first introduces the origin and development of transformational use rules,then analyzes the benefits that transformational use rules can bring to improve China’s fair use system,and finally analyzes the feasibility of introducing transformational use rules into China.The fourth part,proposed consummates our country the rational use of existing system,introducing the transformation rules,clear transformation rules using standard,suggest increase general rules,for the typed analysis of video classification circumstance processing,can be used through transformation into rational use,can’t cut video mixing type suggest additional categories of legal license,The system of shared copyright and compensation is introduced to achieve a win-win situation between copyright and free creation.更多还原
