【摘要】 居住权起源于罗马法,与使用权、用益权共同构成人役权的制度体系。居住权创设初期是为了使弱者的生活居住权利得到保障,具有人身性、期限性、不可转让性等特点。大陆法系诸国继受和发展了此项制度,充分运用于婚姻家庭领域,并通过不同程度的改良,使居住权获得了更广阔的适用空间。我国民法典将居住权纳入立法,从民众需求、司法实践、立法完善等方面看,有其必要性和正当性。目前,民法典从涵义、设立方式、生效要件、行使限制、消灭事由等方面构建了居住权的一般规则,但尚有规范缺失、限制严格、适用面狭窄等缺陷。基于此,笔者在借鉴域外居住权立法经验的同时,结合我国人民群众的实践智慧和司法实务的经验成果,提出对民法典居住权规定的完善建议。以期我国居住权的立法规定能通盘考虑保护弱者和一般财产利用的差异化需要,保持开放的立法方式,最终构建一个保护严格、流转顺畅,集保障性与投资性功能于一体的具有中国特色的居住权制度。更多还原

【Abstract】 The right of habitation,derived from Roman Law,constitutes the system of personal servitude together with the right to use and usufruct.At the very beginning,the aim of the right of habitation was to ensure weak people’s right to live and reside,which is characterized of exclusiveness,termination and inalienability.Then,countries where civil law was applied in inherited and developed this system,which was fully applied in the field of marriage and family.And,by modifying this system,the right of habitation was applied in more fields.Today,China is in the stage of making Civil Code.From the perspective of people demand,judicial practice and legislative improvement,it is be of great significance to include the right of habitation in it.At present,the Property Volume in the Civil Code has regulated the general provisions of the right of habitation in the view of concept,establishment,requirements for effectiveness,restrictions for exercising and reasons for terminating.However,there are still some defects like no specific regulations,strict restrictions and narrow application areas.Therefore,the author put forward some suggestions on how to improve the regulations of the right of habitation in the Property Volume in the Civil Code by learning foreign regulations and domestic experiences.It is expected that the right of habitation in our country can be regulated in an open approach which takes the different needs of protecting the weak and utilizing general property into consideration.As a result,we can build the system of the right of habitation with Chinese characteristics which comprehensively integrates strict protection with frequent circulation.In other words,the right of habitation in China can realize the aim of guarantee and investment at the same time.更多还原
