【摘要】 家庭作为个体共同存在和生活的团体,也是社会的基本单元,家庭职能的正常发挥对于个体与社会都具有不可替代的意义。在道德伦理约束下的家庭本该维持着和谐稳定的状态,然而“家庭革命”后所出现的各种问题,引发了家庭生活中个体间的权利侵害行为普遍存在。个体出于家庭,所以家庭内所发生的侵害行为造成的伤害往往是双倍的。现代中国社会中,基于传统观念下长期认为家庭内部事务是“家事”,奉行“法不入家门”,拒绝外力的参与和干涉。随着全球化的进程,个体本位思想冲击着传统“家文化”,家事问题中个体权益保护的意识开始觉醒,逐渐认识到某些“家事”不只是家庭问题,而是社会问题和法律问题。但是,中国家庭经过时代的洗礼,既保留了传统“家文化”的观念,又吸收了现代个体本位的特征,出现了“半现代半传统”的新特征,中国家庭发展的现状却并不能适应现有的以个人本位为指导的中国法律体系。法律与现实的部分脱节,使得家庭与家事对个体和社会的影响被忽视,长此以往不仅难以切实应对现代社会中的家庭危机,而且缺乏中国本土理念的法律移植也出现了水土不服。当家庭丧失了原有的职能时,个体权益也难以得到保障,法律在家事中的作用如果继续遭到否认,那家庭中个体权益便失去了强有力的后盾;反向的,如果“家事”的特征被颠覆,法律的介入同样会影响家庭职能的发挥,进而损害家庭成员的权益。本文从现实家事问题切入,立足于相关基础理论,为保障家庭职能的充分发挥,反思中国传统家事制度的现实价值,定位我国家事制度的发展方向,指出可能存在的困境和问题,探寻构建具有中国特色的家事制度的路径。更多还原

【Abstract】 The family as a group in which individuals live together,is also the basic unit of society.The regular performance of family functions has an irreplaceable meaning for individuals and society.The family,under the restraint of morals and ethics,should have maintained a harmonious and stable state.However,various problems that have emerged after the "family’s revolution" have caused widespread breaches of rights among individuals in family life.The individual comes from the family,so the damage caused by the family’s violations often is doubled.In modern Chinese society,based on traditional concepts,the affairs of the family was considered "family affairs" and pursue "law that do not enter the house",and external forces should not intervene.With the progress of globalization,individual has impacted the traditional "family culture",and the awareness of individual rights protection in family issues has begun to awaken,we has gradually realized that "family issues" are not just family issues,but social and legal issues.However,after the changes of times,Chinese families have not only retained the traditional concept of "family culture",but also absorbed the features of individual,and the new features of "half modern and half traditional" appeared.The current situation of Chinese family development cannot adapt to the existing Chinese legal system is guided by the individual standard.The partial disconnection between law and reality impacts family and family affairs on individuals and society ignored.In the long run,it is not only difficult to effectively deal with the family crisis in modern society,but also the lack of Chinese native concepts of legal transplantation has also appeared inconsistent.When the family loses its original functions,it isn’t easy to protect individual rights and interests.If the law action in family affairs continues to be reversed,then the function of the family and individual rights will lose a strong backing.On the contrary,if the "family affairs" features has being upended,the intervention of the law will also affect the performance of the family’s functions,and damaging the rights and interests of family members.Based on this,this article cuts into the actual family issues,based on relevant fundamental theories,to ensure the full use of family functions,re-understand the actual value of traditional Chinese family law,position the development direction of our country’s family law,and point out possible dilemmas and problems.Explore the way to build a family law with Chinese characteristics.更多还原
