【摘要】 十八大以来,我国生态文明建设取得了显著成效,生态环境质量持续好转。同时,随着新时代社会主要矛盾的变化,生态文明建设进入压力叠加、负重前行的关键时期,生态问题日益凸显,寻找有效途径巩固和提高已取得的成效迫在眉睫。站在“两个一百年”奋斗目标的历史交汇期,习近平将建设“美丽中国”的伟大目标与全面依法治国的战略布局有机结合,在指导我国生态治理实践的过程中提出了一系列有创见的新思想新观点,为切实推进我国生态法治发展提供了重要理论指导,对于加快推进“美丽中国”建设和全面落实依法治国战略具有重大现实意义。习近平生态法治观是马克思主义中国化的最新理论成果,是对马克思恩格斯生态自然观的继承与发展,是对中国共产党人生态法治观念的传承与创新,也是对西方生态法治理念优秀成果的吸收与借鉴。习近平生态法治观是回应新时代中国特色社会主义发展的现实需要孕育而生的科学实践指南。进入新时代,生态法治的发展处于机遇与挑战并存的关键时期,习近平生态法治观的形成不仅回应了新时代中国生态法治发展的现实挑战,更顺应了中华民族伟大复兴的战略部署。为了有效推进我国生态法治发展,切实提高我国生态治理效能,习近平从全局高度统筹我国生态法治的发展,厘清了坚持党的领导、坚持以人为本、坚持从严治理、坚持全球共治的基本思路,致力于营造社会生态法治氛围、完善生态法律规范体系、健全生态法治实施体系和构建全球生态治理格局四个方面的战略部署,为有效推动我国生态法治发展作出了正确示范,为切实提升生态法治领域的治理效能提供了可行方案。基于对中国特色社会主义法治和当代中国生态问题的深刻认识,习近平生态法治观凸显了深邃的政治智慧、彰显了鲜明的时代特色、表达了深厚的为民情怀,为建设“美丽中国”提供了切实有效的法治保障,也为发展中国法治奠定了鲜明的绿色基调。习近平生态法治观为有效推进我国生态法治发展指明了正确方向,有利于加快我国生态法治的发展进程,有利于推进“美丽中国”建设,有利于推动全球生态治理进程。本文试图以学科融合为视角,深入探寻与研究这一理论的形成背景、理论渊源、主要内容及其现实意义,力求深刻把握其丰富的内涵与理论品质,从而梳理出习近平生态法治观的逻辑进路,助力于我国生态法治的蓬勃发展。更多还原

【Abstract】 Since the 18 th National Congress,the construction of ecological civilization in China has achieved remarkable results,and the quality of ecological environment has been continuously improved.At the same time,with the change of the main social contradictions in the new era,the construction of ecological civilization has entered a critical period of pressure superposition and load forward,and the ecological problems have become increasingly prominent,so it is urgent to find effective ways to consolidate and improve the results achieved.Standing at the historical intersection of the "two hundred years" goals,Xi Jinping organically combines the great goal of building a "beautiful China" with the strategic layout of governing the country according to law in an all-round way,and puts forward a series of innovative new ideas and new viewpoints in the process of guiding the practice of ecological governance in China,in order to effectively promote the life of our country The development of state rule of law provides important theoretical guidance,which is of great practical significance for speeding up the construction of "beautiful China" and fully implementing the strategy of governing the country according to law.Xi Jinping’s view of ecological rule of law is the latest theoretical achievement of Marxism in China,the inheritance and development of Marx and Engels’ view of ecological nature,the inheritance and innovation of the Chinese Communists’ concept of ecological rule of law,and the absorption and reference of the excellent achievements of the western concept of ecological rule of law.Xi Jinping’s view of ecological rule of law is a scientific practical guide to respond to the reality of the development of socialism with Chinese characteristics in the new era.In the new era,the development of ecological rule of law is at the critical moment of the coexistence of opportunities and challenges.The formation of Xi Jinping’s view of ecological rule of law is an urgent need to respond to the real challenges of the development of ecological rule of law in China in the new era,and it is also in line with the Chinese strategic deployment for the great rejuvenation of the nation.In order to effectively promote the development of ecological rule of law in China and effectively improve the efficiency of ecological governance in China,Xi Jinping has coordinated the development of ecological rule of law in China from the overall level,and clarified the basic ideas of adhering to the Party’s leadership,adhering to people-oriented,adhering to strict governance,and adhering to global co-governance.Committed tothe creation of social ecological rule of law atmosphere,improve ecological legal norms system,improve the implementation of ecological rule of law system and build a global ecological governance pattern of four strategic arrangements,for effectively promoting the development of ecological rule of law in China to make a correct demonstration,for effectively improving the effectiveness of governance in the field of ecological rule of law.Based on the deep understanding of the rule of law of socialism with Chinese characteristics and the ecological problems of contemporary China,Xi Jinping’s view of ecological rule of law highlights profound political wisdom,highlights distinct characteristics of the times,expresses deep feelings for the people,provides a practical and effective guarantee of the rule of law for the construction of "beautiful China ",and also lays a clear green tone for the development of the rule of law in China.Xi Jinping’s view of ecological rule of law points out the right direction for effectively promoting the development of ecological rule of law in China,which is conducive to speeding up the development process of ecological rule of law in China,promoting the construction of "beautiful China ",and promoting the process of global ecological governance.This article attempts to take the discipline fusion as the angle of view,deep To explore and study the background,origin,content and practical significance of this theory,try to grasp its rich connotation and theoretical quality,so as to sort out the logical approach of Xi Jinping’s view of ecological rule of law,and help the vigorous development of ecological rule of law in China.更多还原
