【摘要】 古籍点校是指点校者在特定古籍版本的基础上,运用专业知识,依据文字规则、标点规范,对照其他版本或者史料作出判断,对相关古籍划分段落、加注标点、选择用字的过程。实践中,古籍点校成果主要包括单纯的点校本和校勘记两种类型。点校以还原“古籍原貌”为宗旨,是点校人高强度智力劳动的结晶,更是古籍整理工作的根基。近年来,司法实践中与古籍点校相关的案件逐渐增多,但是关于古籍点校成果的性质认定及保护模式选择问题却莫衷一是。古籍点校事关中华传统文化的传承与发扬,与古籍善本的保存以及古籍出版行业的发展走向息息相关,其成果的保护问题应当尤为重视。基于此,有必要针对古籍点校成果法律保护的现有争议和问题,在剖析现有理论争议的基础上,深入研究和探讨古籍点校成果著作权保护的完善措施。本文综合运用法解释学方法、案例分析法、比较分析法等方法,探讨如何完善古籍点校成果的法律保护,并力求提出自己独到的主张和看法,主要包括如下内容:第一部分,古籍点校成果的介绍和保护的必要性。通过对古籍点校及相关概念的对比分析延伸出古籍点校成果的定义和特性,并通过论证古籍点校成果在促进中华传统文化传播、激励文化创新、促进古籍出版等方面的作用,阐明保护古籍点校成果的必要性。第二部分,古籍点校成果的法律定性及法律保护的正当性。以类型化研究的视角,研究古籍点校成果的独创性以明确其法律属性。通过财产权劳动理论、人格理论、激励理论论证古籍点校成果著作权保护的正当性。第三部分,古籍点校成果保护现状的评述。通过梳理当前司法实践中古籍整理类纠纷案件的裁判观点总结出关于古籍点校成果的保护现状,并结合学者们提出的多种保护模式的建议,分析当前我国关于古籍点校成果进行法律保护存在的问题。第四部分,古籍点校成果法律保护措施的完善建议。针对当前古籍点校成果的保护现状,从解决实际问题的角度出发,根据古籍点校成果的类型分别提出具体化的保护措施。单纯的点校本采用邻接权保护模式,将标点行为纳入“版式设计”的范畴,结合标点行为的特点对版式设计权做出适应性调整。校勘记成果采用狭义著作权保护模式,在明确其作品属性的前提下,完善侵犯校勘记成果的责任追究。更多还原

【Abstract】 The collation to ancient books is the process that instructs the schoolers to use professional knowledge on the basis of the specific version of ancient books,mak e a judgment according to the text rules and punctuation standards,compare with o ther versions or historical materials,and divide the relevant ancient books into para graphs,add punctuation marks and choose the words to use.In practice,the achiev ements of collation to ancient books mainly include two types: the achievements of punctuation and paragraph arrangements to ancient books(also called proof)and the notes of collation.With the purpose of restoring "the original appearance of ancien t books",the collation is the crystallization of the high intensity intellectual work o f the collation expert,and it is also the foundation of the arrangement of ancient b ooks.In recent years,there have been more and more cases related to ancient book proof in judicial practice,but there is no agreement on the nature identification an d protection mode selection of the achievements of ancient book collating.Ancient book collation is closely related to the inheritance and development of traditional C hinese culture,the preservation of rare books and the development of ancient book publishing industry,so the protection of its achievements should be paid special att ention to.Based on this,it is necessary to study and discuss the measures to impr ove the copyright protection of the achievements of ancient book proofreading on t he basis of analyzing the existing theoretical disputes,aiming at the existing dispute s and problems in the legal protection of the achievements of ancient book proofre ading.This paper discusses how to improve the legal protection of the results of a ncient book revision by means of comprehensive application of hermeneutic method,case analysis method and comparative analysis method,and makes every effort to put forward its own unique opinions and opinions,including the following contents:The first part is about the necessity of the introduction and protection of the a chievements of ancient books collating.Through the comparative analysis of ancient book collation and related concepts,the definition and characteristics of the achiev ement of ancient book collation are extended,and the necessity of protecting the ac hievement of ancient book collation is expounded by demonstrating the role of the achievement of ancient books collation in promoting the dissemination of traditional Chinese culture,stimulating cultural innovation and promoting the publication of an cient books.The second part is about the legal nature and the legitimacy of the legal prote ction of collation of the ancient books.From the perspective of typology research,t he originality of the research results to ancient book proofreading is studied to clari fy its legal attribute.Through the property rights labor theory,personality theory,incentive theory to demonstrate the legitimacy of copyright protection.The third part is a review of the status quo of the preservation of the achieve ments of collation of the ancient books.This paper summarizes the current situation of the protection of ancient books’ registration results by sorting out the opinions of the ancient books’ arrangement disputes in the current judicial practice,and anal yzes the existing problems in the legal protection of ancient books’ registration resu lts in China based on the Suggestions of various protection modes put forward by scholars.The fourth part is the Suggestions on improving the legal protection measures for the achievements of ancient books.In view of the current situation of the prote ction of the achievements of ancient book point of view,from the perspective of s olving practical problems,according to the types of the achievements of ancient bo ok point of view,specific protection measures are proposed.The simple achievemen ts of punctuation and paragraph arrangements to ancient books adopts the protection mode of adjacent rights,and brings punctuation behavior into the category of "lay out design",and makes adaptive adjustment to layout design right according to the characteristics of punctuation behavior.In the narrow sense,the copyright protection mode is adopted to improve the accountability for the violation of the achievement s of collating records on the premise of clarifying the properties of the works.更多还原
