【摘要】 涉黑涉恶刑事案件中涉案财物处置问题是检验涉黑涉恶刑事案件社会效果与法律效果的试金石。刑事诉讼中涉案财物规范化处置是一个系统性的问题,需要公、检、法等司法机关协调配合,统一思想,并且需要规范侦查思维、强调庭审审查、建立涉案财物保管制度等一整套程序,确保思想上和程序上予以规范和强调,这样才能通过涉案财物有效处置铲除黑恶势力犯罪分子的经济基础,使被害人的经济损失得到及时的挽回,使被破坏的社会秩序得到尽快恢复。本文通过对涉案财物的概念的介绍,从而确定侦查机关查扣涉案财物的范围,防止违规查封;通过确立涉案财物庭审审查制度,保障被告人及利害关系人能够有效参与涉案财物庭审审查,充分保障被告人的辩护权,同时也落实案件事实查明在法庭的刑事诉讼制度改革要求,也能够有效保障被告人的自我辩护权;通过扩大被害人及利害关系人权利救济途径,从而更有利于保障被害人及利害关系人的权益,增加案件办理的社会效果和法律效果的统一。文章最后,通过对“套路贷”案件中违法所得的分析,来洞悉整个涉黑涉恶案件中涉案财物处置的困难及解决之方,在涉黑涉恶案件中涉案财物的处置应坚持不应在违法犯罪中获利的原则和综合全案进行利益平衡原则相结合,只有这样才能使涉黑涉恶案件涉案财物的处置在法律效果和社会效果上达到完美的统一。更多还原

【Abstract】 The disposal of property involved in criminal cases is the touchstone to test the social effect and legal effect of criminal cases.The standardized disposal of property involved in criminal proceedings is a systematic problem,which needs the coordination and unification of the public security oragnization,procuratorial and law court,and the need to standardize the procedure of investigation thinking,emphasizing the court review,the establishment of a case-related property custody system to ensure that they are standard and emphasized.Only in this way to wipe out the economic base of gangs and evils and timely recover the economic losses of the victims,and restore the social order that has been destroyed.By analyzing the concept and scope of the property involved in the case,this paper determines the scope of the seizure,seizure and freezing of the property involved in the case to prevent the seizure beyond the scope;By expanding the remedies of the victims and the interested parties,the rights and interests of the victims and the interested parties will be protected,and the social and legal effects of case handling will be increased.Finally,through the analysis of the illegal income in the "Taolu loan" case,the difficulties and solutions of the disposal of the money and property involved in the whole crime-related and evil-related case can be discerned,the handling of property involved in criminal cases should adhere to the principle of not profiting from crimes and the principle of balancing interests in a comprehensive case,only in this way can the disposal of the property involved in the criminal cases be perfectly unified in the legal effect and the social effect.更多还原
