家事调查报告效力研究

【摘要】 家事案件的数量激增,而家事纠纷法律依据缺失,促使了家事审判改革的产生。基于维护婚姻家庭的稳定、保护弱势群体的合法利益、促进社会和谐健康发展的目的,最高人民法院推进家事审判改革,为提高家事审判的司法服务和保障水平,探索引入家事调查员制度。家事调查报告作为家事调查员制度的有机组成部分,提高其效力能增强其解决家事纠纷的能力,提高家事调解的成功率,对于家事审判的程序正义与实质正义的实现均具有重要作用。本文以家事调查报告的效力为研究对象,围绕家事调查报告的效力认定规则和证据资格、证明力等展开,正文据此可分为四个部分:第一部分,阐述家事调查报告相关的基本理论。从作为全文研究基础的家事调查相关概念出发,确定家事调查报告的制作主体,明确家事调查报告的价值,界定家事调查报告的效力,从而为后文的分析作出铺垫。第二部分,考察家事调查报告的效力认定情况。主要通过考察司法规则和试点地区的司法实践情况对家事调查报告的认定情况,而后从证据资格和证明力两个方向对家事调查报告的效力进行考察,发现家事调查报告效力存在的问题,为进一步提高家事调查报告的适用性提供改进方向。第三部分,家事调查报告效力的比较分析。分别选取英美法系和大陆法系的典型国家(地区)相似制度下的家事调查报告效力进行考察,由于制度背景存在差异,故制度称谓及调查报告的适用案件范围和适用方式等也存在差异,但在调查主体选任、调查报告制作等方面存在共通之处,能够为我国提供有益性的做法借鉴。第四部分,保障家事调查报告效力的建议。从完善家事调查程序、明确家事调查报告证据效力和家事调查报告的审查与认定三个方面着手,结合司法实践和域外经验进一步探索减少家事调查报告效力争议的路径,针对家事调查报告效力存在的问题提出解决建议,以保障未来家事调查报告的效力。更多还原

【Abstract】 The number of family cases has surged,and the lack of legal basis for family disputes has prompted the reform of family trials.In order to maintain the stability of marriage and family,protect the legitimate interests of vulnerable groups,and promote the harmonious and healthy development of the society,the Supreme People’s Court has promoted the reform of family trials,and explored the introduction of a family investigator system in order to improve the level of judicial services and protection of family trials.The family investigation report is an organic part of the family investigator system.Increasing its effectiveness can enhance its ability to resolve family disputes and increase the success rate of family mediation.It plays an important role in the realization of procedural justice and substantive justice in family trials.This article takes the effectiveness of the family investigation report as the research object,and focuses on the rules for determining the effectiveness of the family investigation report,the qualification of evidence,and the power of proof.The first part expounds the basic theory related to the family investigation report.Starting from the related concepts of family investigation as the basis of the full-text research,determine the main body of the family investigation report,clarify the value of the family investigation report,define the effectiveness of the family investigation report,and pave the way for subsequent analysis.The second part examines the validity of the family investigation report.The identification of the family investigation report is mainly made by examining the judicial rules and the judicial practice in the pilot areas,and then the effectiveness of the family investigation report is examined from the two aspects of evidence qualification and probative power.It is found that there are problems in the effectiveness of the family investigation report.Improving the applicability of family investigation reports provides direction for improvement.The third part is a comparative analysis of the effectiveness of the family investigation report.The effectiveness of family investigation reports under similar systems in typical countries(regions)of the common law system and the Civil law were selected to investigate.Due to differences in the background of the system,thereare differences in the scope and methods of application of system titles and investigation reports.However,there are similarities in the selection of the investigation subject and the production of the investigation report,which can provide useful reference for our country.The fourth part is the suggestions to guarantee the effectiveness of the family investigation report.Starting from three aspects of improving the family investigation procedure,clarifying the evidence effectiveness of the family investigation report,reviewing and identifying the family investigation report.Combining judicial practice and extraterritorial experience to further explore ways to reduce disputes over the effectiveness of the family investigation report,and addressing the problems with the effectiveness of the family investigation report.Propose solutions to ensure the effectiveness of future family investigation reports.更多还原
