我国集体合同制度的检讨

【摘要】 通过集体合同来调整劳动者集体和企业之间关系的制度发源于西方市场经济较为发达的国家,经过几个世纪的发展和完善,逐步成为平衡劳资力量、协调社会经济秩序的一项重要制度。我国集体合同制度立法最早见于1994年的《中华人民共和国劳动法》,中华全国总工会也多次要求各级工会要着重加强集体合同制度的推动。此后的20多年,集体合同制度在和谐劳动关系、维护职工权益方面取得了丰硕成果。但随着国际经济环境的变化、国内市场经济的深化和劳资关系的复杂化,集体合同制度在实施过程中出现发展不均衡、重指标轻协商和重签约轻履行等现象。这些现象产生的原因一方面是劳资双方对集体合同制度认识的不足导致主观能动性不够,但更为重要的是因为集体合同作为一种法律制度的建立和实施还存在不足,影响了集体合同制度的权威,使其在化解劳资矛盾方面没有真正发挥基础性作用。所以应当从法律制度的设计入手,通过合理完善和健全集体合同制度来破题。
【Abstract】 The system of adjusting the relationship between labor groups and enterprises through collective contracts originated in the developed countries of western market economy,and after several centuries of development and improvement,it gradually became an important system to balance labor force and coordinate social and economic order.The legislation of collective contract system in China was first seen in “The Labor Law of The People’s Republic of China” in 1994,and The All-China Federation of Trade Unions repeatedly asked trade unions at all levels to focus on strengthening the promotion of the collective contract system.Over 20 years since then,the collective contract system has achieved fruitful results in harmonious labor relations and safeguarding workers’ rights and interests.However,with the change of the international economic environment,the deepening of domestic market economy and the complexity of labor-capital relations,the development of collective contract system is unbalanced in the process of implementation,with emphasis on indicators rather than consultation,and on signing contracts rather than performance.The reasons for these phenomena are on the one hand,due to the inadequate understanding of collective contract system between employers and employees which leads to inadequate subjective initiative,but more importantly,the inadequacy of the establishment and implementation of collective contracts as a legal system affects the authority of the collective contract system and makes it not play a real fundamental role in resolving the contradictions between employers and employees.Therefore,we should start with the design of the legal system and solve the problem by rationally improving and perfecting the collective contract system.
