【摘要】 互联网科技的发展将我们的社会带入全新的网络信息时代,微信、支付宝、微博等早已与我们的生活密不可分,随着虚拟财产的种类和范围的增多,有关虚拟财产的纠纷也一直增加。与虚拟财产有关的问题如涉及隐私的虚拟财产能否被继承、虚拟财产的法律属性等一直是学术界的热门话题。尽管《民法总则》已经将虚拟财产纳入法律保护的范围,但该规定没有对虚拟财产的继承作出明确规定,这对于社会生活和审判实践有着非常重要的指导意义。本文将以虚拟财产的权利属性作为切入点,主要分为五部分进行分析研究,意在解决虚拟财产继承过程中的主要问题。第一部分对虚拟财产的概念及权利属性进行分析,认为虚拟财产符合物权的客体特征,进而可以成为继承的客体。第二部分对虚拟财产继承的必要性和可行性进行研究,虚拟财产的继承既是物质财富和精神财富的延续,又是对网络秩序的维护,同时也是对所有权的保护,因而有必要建立虚拟财产的继承制度。虚拟财产因其兼具经济价值和精神价值可以成为继承的客体,加之现行法律对虚拟财产的继承提供了保障,虚拟财产继承具备可行性。第三部分对虚拟财产继承的主体和客体进行深入分析,包括虚拟财产的所有权归属及虚拟财产继承客体的范围。第四部分是分析目前网络服务协议和隐私保护制度对虚拟财产继承的限制,提出自己的观点即排除隐私权的网络服务协议无效,涉及隐私权的虚拟财产不能被继承。最终在第五部分提出关于虚拟财产立法构建的建议,希望通过法律规定的形式明确虚拟财产继承程序并规范网络运营商的义务,为司法实践和理论研究提供思路,保护公民的财产权,完善我国继承法律体系。虚拟财产继承制度关系到公民财产权益的保护,明确虚拟财产的继承程序不仅可以有效解决司法实践中与虚拟财产继承有关的纠纷,保护用户对虚拟财产的权益,维护网络秩序,对我国的法制化建设也有积极的推动作用。更多还原

【Abstract】 Network technology brings our society into the information age,WeChat,Alipay,Weibo,etc.have long been inseparable from our lives.With the increase in the types and scope of virtual property,disputes about virtual property are also increasing.The question of whether the virtual property related to privacy can be inherited,the legal property of the virtual property,and other virtual property inheritance has been a hot topic in academia..Although the "General Rules of Civil Law" has included virtual property within the scope of legal protection,the provision has not specify the inheritance of virtual property,which has very important guiding significance for social life and judicial practiceThis article will take the right attribute of virtual property as an entry point,mainly divided into five parts for analysis and research,intended to solve the main problems in the process of virtual property inheritance.The first part research the concept of virtual property and the attribute of rights,and believes that virtual property conforms to the object characteristics of real rights,and can then become the object of inheritance,can be inherited by heirs.The second part studies the necessity and feasibility of the inheritance of virtual property.The inheritance of virtual property is not only the continuation of material and spiritual wealth,but also the maintenance of network order and the protection of ownership,so it is necessary to establish virtual property succession system.Virtual property can be the object of inheritance because it has both economic value and spiritual value.In addition,the current law provides guarantee for the inheritance of virtual property,it is feasible in the process of virtual property inheritance.The third part makes an in-depth analysis of the main party and object of virtual property inheritance,including the ownership of virtual property and the scope of virtual property inheritance object.The fourth part is to analyze the limitations of the current network service agreement and privacy protection system on the inheritance of virtual property,and put forward my own view that the network service agreement excluding privacy is invalid,and the virtual property related to privacy cannot be inherited.Finally,in the fifth part,we put forward suggestions on the construction of virtual property legislation,hoping to clarify the inheritance procedures of virtual property and regulate the obligations of network operators in the form prescribed by law,provide ideas for judicial practice and theoretical research,protect the property rights of citizens,and improve inheritance Legal SystemThe virtual property inheritance system is related to the protection of citizens’property rights.It is clear that the virtual property inheritance procedure can not only effectively resolve disputes related to virtual property inheritance in judicial practice,protect users’rights and interests of virtual property,and maintain the stability of the network order.Legalization also has a positive role in promoting.更多还原
