【摘要】 随着我国法治理念的不断完善,人们对生活的要求也在不断提高,相比传统的家庭观念来讲,离婚对现代年轻人而言已习以为常,这就导致我国司法机关每年接受的离婚诉讼案件数量逐年提升,离婚年龄越来越小,这无形中给我国司法机关审理离婚诉讼案件带来了一定的困扰。在离婚纠纷案件审理中,夫妻共同财产的分割和共同债务的认定一直就是司法机关审理过程中的难点所在,如何认定夫妻共同债务对于离婚纠纷案件审理来说意义重大,夫妻共同债务的认定涉及到债权人以及夫妻双方的利益,所以离婚案件中确立了“共签共债”制度。除此之外根据夫妻共同债务清偿制度能否用于满足夫妻家庭日常生活的需要确定了举证责任二次元原则,但由于离婚纠纷往往情况比较复杂,以至于我国夫妻共同债务的认定规则还存在一定的瑕疵。那么如何合理的认定夫妻共同债务、保护相关债务人的利益就成为我国离婚纠纷案件审判的关键,探究夫妻共同债务认定规则是本文研究的重要内容。首先,对夫妻共同债务进行引言分析,通过研究背景和问题提出表明研究夫妻共同债务认定规则的意义,并通过对夫妻共同债务相关真实数据的统计和分析,更加直观的看到我国夫妻共同债务存在的不足和缺陷,为后续研究夫妻共同债务认定规则做好研究基础;其次,为了更好的了解夫妻共同债务,通过对夫妻共同债务的理论依据,定义、特征以及司法机关处理夫妻共同债务一般规则进行详细的分析;再次,通过统计总结笔者调查研究的真实数据来总结我国夫妻共同债务认定规则的现状,然后对从现状中发现我国立法在夫妻共同债务上存在的争议,并对这些法律规定进行论述,对我国夫妻共同债务认定规则存在的问题和不足进行讨论分析,这也是本文研究的重点。探究这些问题背后产生的原因,针对之前提出的完善建议未完成的进行深入分析。最后在前面四部分的研究基础上,对我国现有的夫妻共同债务认定规则存在的不足提出一些可行的完善建议,对我国夫妻共同债务认定规则贡献自己的一份力量。更多还原

【Abstract】 With the continuous improvement of the concept of the rule of law in China,people’s requirements for life are also constantly improving.Compared with the traditional family concept,divorce has become more and more common for modern young people,which leads to the number of divorce cases accepted by the judicial organs every year increasing year by year,and the age of divorce is getting smaller and smaller,which virtually brings about the trial of divorce cases by the judicial organs in China There are some problems.In the trial of divorce dispute cases,the division of husband and wife’s common property and the determination of joint debt are always the difficulties in the trial process of judicial organs.How to determine the debt belongs to the joint debt of husband and wife is of great significance for the trial of divorce dispute cases,because the determination of joint debt of husband and wife involves the interests of creditors and both husband and wife,so divorce The system of "co signing and co debt" was established in the case.In addition,the dual principle of burden of proof is determined according to whether the settlement system of husband and wife’s joint debt can be used to meet the needs of husband and wife’s daily life.However,due to the complexity of divorce disputes,there are still some flaws in the recognition rules of husband and wife’s joint debt in China,so how to reasonably identify the husband and wife’s joint debt and protect the interests of related debtors becomes The key to the trial of divorce dispute cases in China is to explore the recognition rules of husband and wife’s joint debt,which is an important part of this paper.Firstly,the introduction of husband and wife’s joint debt is analyzed.Through the research background and problems,it shows the significance of studying the recognition rules of husband and wife’s joint debt,and through the statistics and analysis of the real data related to husband and wife’s joint debt,we can more directly see our husband The deficiency and defect of the wife’s joint debt will lay a good foundation for the following research on the recognition rules of the husband and wife’s joint debt.Secondly,in order to better understand the joint debt of husband and wife,this paper analyzes the theoretical basis,definition,characteristics and the general rules of the judicial authorities dealing with the joint debt of husband and wife in detail.Thirdly,through the statistical summary of the real data of the author’s investigation and research,this paper summarizes the current situation of the recognition rules of the husband and wife’s joint debt in China,and then finds out the disputes on the husband and wife’s joint debt in China’s legislation from the current situation,and discusses these legal provisions.Thirdly,it discusses and analyzes the problems and shortcomings of the recognition rules of the joint debt of husband and wife in China,which is also the focus of this paper.It explores the reasons behind these problems,and does not improve the proposal for in-depth analysis.Finally,on the basis of the previous four parts of the research,this paper puts forward some feasible suggestions to improve the existing rules of the recognition of husband and wife’s joint debt in China,and contributes to the recognition of husband and wife’s joint debt.更多还原
