【摘要】 外空委法律小组第56届委员会上,会议讨论决定新增一项“关于空间资源探索、开发和利用活动的潜在法律模式的一般性意见交流”的议题。法律小组希望借助对该议题的讨论尽早制订出外空资源开发活动相关的具体规则,填补国际外空法律框架下现存的法律空白。为积极响应外空委法律小组的号召,海牙外空资源治理工作组制订出《关于外空资源活动国际框架文本草案》,并于2017年9月对外公布了该草案。《关于外空资源活动国际框架文本草案》的制定者主要由欧美国家以及新兴的亚洲空间国家组成,出于国家空间战略目标的考量,草案极大程度上会在他们的助推下成为外空法律小组的重点参考对象,甚至成为新的外空条约的讨论内容。本文通过研究《关于外空资源活动国际框架文本草案》,归纳草案制订过程中出现的草案文本性质的归属、条文下某些原则内容的设置、是否赋予活动主体外空资源的专属权、外空资源财产权在国际范围内的认可问题以及建立怎样的开发利益分享机制等争议焦点。通过分解、剖析这些争议焦点背后各个国家的不同利益诉求,从而判断草案内容可能的发展方向以及对现有外空资源活动规则《外空条约》、《月球协定》以及对未来外空资源活动规则构建、各个国家的相关国内立法可能产生的影响。最后,通过对《关于外空资源活动国际框架文本草案》相关文献的收集、分析,笔者吸取部分学者的观点,面对草案出台可能带来的影响以及外空资源开发活动中可能遇见的问题,笔者建议中国可以从国际和国内两个层面考虑具体的应对措施。就国际层面而言,中国应在草案的讨论过程积极发挥大国影响力,表明中国在外空资源活动问题上的立场,在借助草案提供的讨论平台发表中国意见的同时促进外空资源活动国际规则的搭建。在国内层面,中国应当加强对外空资源活动规则的研究,努力完善外空资源活动相关的国内立法。同时,笔者希望通过各国以及国际社会的共同努力,促使外空资源开发活动朝着有利于全人类共同利益的方向发展，最终实现人类命运共同体的发展目标。更多还原

【Abstract】 The 56 th Committee of the Legal Committee of the Committee,the meeting discussed the decision to add a new topic “General exchange of views on potential legal models for space resource exploration,development and utilization activities”.The legal team hopes to use the discussion on this topic to formulate specific rules related to outer space resource development activities as soon as possible,and to fill the existing legal gap under the international space legal framework.In order to respond positively to the call of the Legal Committee of the Committee,the Working Group on Outer Space Resources Governance of The Hague developed the Draft Text on the International Framework for Outer Space Resources Activities,which was published in September 2017.The drafters of the draft text on the international framework for outer space resource activities are mainly composed of European and American countries and emerging Asian space countries.Due to the consideration of national space strategic objectives,the draft will become a space under their assistance.The key reference objects of the legal group have even become the discussion content of the new outer space treaty.This paper studies the draft text of the international framework on outer space resource activities,summarizes the attribution of the nature of the draft text appearing in the drafting process,the setting of certain principles under the provisions,whether to grant the exclusive rights of the active subjects to outer space resources,and outer space.The issue of the recognition of resource property rights in the international arena and the development of interest sharing mechanisms such as the development of benefit sharing mechanisms.By decomposing and dissecting the different interests of various countries behind these controversial points,we can judge the possible development direction of the draft contents and the rules of the existing outer space resources activities,the Outer Space Treaty,the Moon Agreement,and the rules for future outer space resources activities.Construction,the possible impact of relevant national legislation in various countries.Finally,through the collection and analysis of the relevant literature on the draft of the International Framework for the Activities of Outer Space Resources,the author draws on the views of some scholars,the possible impact of the introduction of the draft and the problems that may be encountered in the development of outer space resources.The author suggests that China can consider specific countermeasures at both the international and domestic levels.At the international level,China should actively play the influence of big powers in the discussion process of the draft,indicating China’s position on the issue of outer space resource activities,and promoting the international rules of outer space resources activities while expressing China’s opinions through the discussion platform provided by the draft.Build.At the domestic level,China should strengthen research on the rules for the activities of outer space resources and strive to improve domestic legislation related to outer space resource activities.At the same time,the author hopes that through the joint efforts of all countries and the international community,the development of outer space resources will be developed in a direction that is beneficial to the common interests of all mankind,and ultimately the development goal of the community of human destiny.更多还原
