【摘要】 青少年犯罪是全球人类社会均面临的重大社会难题,其危害性被认为仅次于毒品犯罪和环境污染,是社会公共秩序和安全治理中的不定时炸弹。我国近年来一直致力于预防和打击青少年犯罪,青少年的犯罪率虽然低于发达国家,但仍难改逐年上升的趋势。预防和减少青少年违法犯罪已成为我国创新社会治理的重要内容和维护社会稳定的具体体现。青少年罪犯具有主观恶性浅、可塑性强及稳定性差的特点,若对其实行监禁刑不仅容易使其被贴上标签、造成交叉感染,而且更不利于其再社会化。社区矫正的优势在于充分调动社区力量,发掘社会多方资源为青少年罪犯创造一个良好的悔过、自新的社会环境,使其弃恶习、学新知,有效的防止他们重新犯罪。本文通过文献法、个案研究法、访谈法、比较分析法等研究方法,主要对青少年犯罪适用社区矫正的必要性及青少年社区矫正监管中存在的问题进行剖析,比较、借鉴英美、大陆法系中具有代表意义的国家关于青少年社区矫正方面的工作经验,立足中国的社会现状,对我国青少年社区矫正制度进行深入、扎实的研究。从加快《社区矫正法》立法建设、设立专门的青少年社区矫正部门、建立社会多方力量参与的监管队伍、细化所适用的矫正措施等方面探索、研究适合青少年社区矫正对象的监管体系。更多还原

【Abstract】 Juvenile delinquency is classified as the third-largest public nuisance worldwide,following drug abuse and traficking,and environmental pollution.It is a prominent social problems around the world.Our country have been committed to the prevention and combating of juvenile delinquency in recent years.Although the rate of juvenile delinquency is lower than in developing counties,it is hard to change the increasing trend.The prevention and reduction of juvenile delinquency has become an important part of innovative social governance and the concrete manifestation of maintaining the social stability in our country.Juvenile offenders have the features of shallow subjective malignant,plasticity and poor stability.If we implement imprisoned punishment to them,it will easily make them be labelled and cause cross-infection.What’s worse,it will be harmful to their resocialization.The advantage of community correction is to mobilize community strength,to explore social resources for young offenders to provide a good social environment,rehabilitation of repentance,to correct the bad habits,and to prevent juvenile delinquency effectively.Through literature review,case study,interview and comparative analysis,this article mainly analyzes the necessity of the application of community correction of juvenile delinquency and the problem of juvenile community correction supervision.In the representative of the significance of the country on the youth community correction work experience,so as to the juvenile community correction supervision system for a comprehensive,solid research.From accelerating "community correction law" legislation construction,setting up a special juvenile community correction department,establishing social forces to participate in the community correction team,detailing the application of juvenile community correction measures and other aspects to explore and research for juvenile community correction of the image of the regulatory system.更多还原
