【摘要】 监狱是国家的刑罚执行机关,是践行法治精神、体现公平正义、惩罚预防犯罪的国家机器,是推进依法治国的重要一个环节。2011年以来,我国相继对《刑法》、《刑事诉讼法》进行修订,并出台了相应的司法解释。刑事政策的调整对重刑犯监狱罪犯改造产生了巨大的影响,原有的以减刑为核心的罪犯改造激励模式失效,监狱安全隐患陡增,“惩罚与改造相结合,以改造人为宗旨”的监狱工作原则受到挑战。在此背景下,本文从重刑犯监狱实际出发,从理论和实证模型两方面来研究重刑犯改造激励模式的重建和创新,采用文献研究法、问卷调查法、访谈研究法、案例分析法等方法,按照提出问题、分析问题、解决问题的思路。从刑事政策调整后重刑犯监狱罪犯改造激励存在的问题入手,利用激励理论构建重刑犯监狱罪犯改造激励模型,得出一系列具有参考价值的研究成果。在理论方面,本文研究了一般激励理论、罪犯改造激励理论、重刑犯的概念、特征及适用性关系,构建了重刑犯监狱罪犯改造激励模型;在实证方面,本文以重刑犯监狱——C监狱为案例,进行实证研究,根据C监狱在刑事政策调整背景下罪犯改造激励存在的问题,依照重刑犯改造激励模型,提出了重刑犯监狱罪犯改造激励的对策和建议。本论文共分五部分,第1章绪论,概述了本文的研究背景,研究意义,国内外研究现状,文献评述以及研究内容、方法和思路;第2章,概述了与本文相关的理论,并将一般激励与罪犯改造激励进行了应用性分析;第3章,对重刑犯监狱—C监狱现阶段罪犯改造激励存在的问题进行实论研究和分析,并分析得出存在问题的原因;第4章构建了重刑犯监狱罪犯改造激励模型;第5章,针对重刑犯监狱罪犯改造激励存在的问题,依据重刑犯罪犯改造激励模型,从改造激励内容、改造激励过程、改造激励反馈三方面提出对策。本文的创新点在于:基于激励理论对重刑犯监狱罪犯改造进行研究,构建重刑犯罪犯改造激励模型,是对一般激励理论和罪犯改造激励理论的融合,也是在刑事政策调整后对罪犯改造手段的创新性探索。为解决现阶段重刑犯监狱罪犯管理的“困局”,构建以政治改造为统领的“五大改造”新格局,提供了智力支撑。更多还原

【Abstract】 Prison is the State’s panel enforcement organization,the state machine for practicing the Rule of Law,reflecting fairness and justice,punishing and preventing crime and an important link in running the country according to law.Since 2011,China has carried on the revision to the Criminal Law and the Criminal Procedure Law one after another and issued a corresponding judicial interpretation.The adjustment of the penal policies has had a great influence on the reform of the felons,invalidating the original model of reformation and encouragement of criminals with commutation of sentence as the core,increasing the hidden danger of prison security sharply and making prison principles-combination of punishment and reform and the aim at transforming people being challenged.Under this background,starting from the actual work of the felony prison,I study the reconstruction and innovation of the incentive model of the reform of the felons from the two aspects of theory and empirical model.using the methods of literature research,questionnaire,interview,case analysis,etc.,along the line of thinking-put forwards problems,analysis problems and solve problems.Firstly,I will point out the problems in the incentive and transformation model in a prison of felons after the adjustment of the penal policy,and then obtain a series of valuable research results.In theory,I analysis the links of the thoery of incentive and transformation,the general incentive theory,the concept,the characteristics of felony and the applicability.And I also analysis an empirical case of Prison C to find the problems existing in the Reformation and Encouragement Model under the background of adjustment of criminal policy,and following the model of reformation and encouragement of felons,I will put forwards some relative countermeasures and suggestions.This paper is divided into five parts.The first and introductory chapter provides the research background,significance,current research situation at home and abroad,literature survey,contents,methods and direction of the research.Chapter 2 gives an overview of the theories related to the paper and analysises the application of the General Incentive Model and Criminal Reform Incentive Model.Chapter 3 studies and analysises the problems existing in the Reform Incentive of criminals at present and comes up with the resons.Chapter 4 establishes the Model of the Reformation and Encouragement of prioners in felony prison.Chapter 5,aiming at the problems existing in the Reform Incentive of felons and according to the Model,puts forward the countermeasures and suggestions from three aspects– the incentive concent,process and feedback.The innovation of the paper is to establish the Model of the Reformation and Encouragement of felons,to find the combination of General Incentive Model and Criminal Reform Incentive Model based on the research of incentive model for the felons,and also is innovative exploration of ways to reform criminals after the adjustment of criminal policy,providing intellectual support for solving the tough situation of management of felons at this stage and building a new setup-“Five Major Reforms”,led by Political Transformation.更多还原
