【摘要】 自2009年上半年以来,以葱、姜、蒜为首的一批小宗农产品价格开始剧烈的起伏跌宕,严重的影响了消费者和生产者的生活,在社会上引起了广泛关注。虽然小宗农产品不若大宗农产品那般比重,但是也是人民生活中无法缺少的一部分,它的价格异常,暴涨暴跌,造成了极其恶劣的影响,不仅影响市场价格体系,加剧对通货膨胀的预期,也极大的影响农业生产秩序,使农民遭受损失,百姓的生活质量下降。本文以2012年初至2017年5月山东省金乡县大蒜的价格作为阐述分析的数据基础,通过数据的分析剖析价格波动的规律,起伏的特征,并挖掘小宗农产品价格波动的成因,如供求关系的不平衡、市场游资的炒作、法律政策的滞后等几方面原因,总结目前政府已做出的对价格异常波动的调控手段和已有的效果,分析其中不足之处。参考发达国家如美国、日本对于如何调控农产品价格异常波动做出的政策性手段的经验借鉴,该部分对美国、日本等发达国家的农产品价格支持政策和对价格异常变动做出的措施进行了梳理,由于国外并不分小宗大宗农产品的概念,在其中筛选总结了能够适用于小宗农产品价格异常波动法律调控的内容,整理其中相似的先进的经验方法,总结了完善我国小宗农产品价格异常波动治理政策的经验启迪。最后本文阐述了我国目前对于调控小宗农产品价格波动的目标,并就目前实施的情况做出相应的完善措施,完善农产品价格调控相关领域的立法,目前我国在农产品价格领域的立法主要是《价格法》,尚有待完善立法的架构;明确执法机构的权限和权力范围,将权利职责具体化,明晰各自的权利义务,和立法框架的完善相辅相成;健全农村专业合作社,我国目前已经在重视农村专业合作社的功能性发展,在此方面可以多借鉴国外发达国家的经验,真正让农村专业合作社成为菜农和是常见的枢纽,改变菜农的弱势的地位;建立农产品信息共享平台机制,必须确保信息的及时性、真实性和可查性,目前也有很多的商业性平台可以查询价格,但收费昂贵,政府部门的网站查询的难度也同样不小,要及时改善这样的情形。更多还原

【Abstract】 In recent years,small varieties of mung bean,garlic,ginger and other varieties of agricultural products have experienced "roller coaster"-style price fluctuations,which have had a greater impact on consumers and producers,and have aroused widespread concern in society.Small agricultural products may not always appear to be insignificant.However,once they experience abnormal fluctuations in prices,they will rise and fall sharply.Their impact will be very bad.They will not only affect the market price system,but also aggravate expectations of inflation and will also greatly affect agriculture.Production order has caused peasants to suffer losses and the people’s quality of life has declined.Based on the data of garlic prices in Jinxiang County,Shandong Province,from early 2012 to May 2017,this paper analyzes the characteristics and mechanism of price fluctuations,and then determines the causes of abnormal price fluctuations,including the reduction of planted area and the increase in cost.There are several reasons for speculation in market hot money and lagging of legal policies.Summarize the measures and existing effects that the government has made on abnormal price fluctuations,and analyze the deficiencies.Based on the data of garlic prices in Jinxiang County,Shandong Province,from early 2012 to May 2017,this paper analyzes the characteristics and mechanism of price fluctuations,and then determines the causes of abnormal price fluctuations,including the reduction of planted area and the increase in cost.There are several reasons for speculation in market hot money and lagging of legal policies.Summarize the measures and existing effects that the government has made on abnormal price fluctuations,and analyze the deficiencies.In the end,this article elaborated China’s current goal of regulating price fluctuations of small agricultural products,and made corresponding improvement measures on the current implementation to improve the legislation related to agricultural product price regulation.The current legislation for agricultural product prices in China is mainly""Price Law" still needs to improve the structure of legislation;define the authority and scope of power of law enforcement agencies,specify the rights and responsibilities,clarify their respective rights and obligations,and complement each other with the improvement of the legislative framework;and improve the rural professional cooperatives.China is now paying attention to rural areas.The functional development of professional cooperatives can learn from the experience of foreign developed countries in this respect.It is really a way to make rural specialized cooperatives become a common hub for vegetable farmers and change the status of disadvantaged vegetable farmers.To establish a mechanism for information sharing platform of agricultural products,information must be ensured.Timeliness,authenticity,and accountability,there are many commercial platforms that can inquire about the price,but the charges are expensive.The difficulty of the government department’s website query is not small,so we must promptly improve the situation.更多还原
