【摘要】 政府投资一直被视为是推动国家经济增长的三驾马车之一,公共项目是政府投资的重要领域,因此,合理有序的增加政府对公共项目的投资能够有效推动经济增长。新时代的新发展理念,秉承质量第一与效益优先原则,这对当前公共工程项目的实施提出更多严格要求。公共工程项目一般通过正式实施实现项目竣工,但因受契约非完全性和环境不确定性等因素干扰,公共工程项目实施往往会走入非正式实施路径。因而本文通过对公共工程项目的非正式实施现象描述,探析公共工程项目非正式实施过程中所存在的原因与隐患,并对公共工程项目非正式实施中所存在的隐患,提供优化建议。本文首先回顾了目前学术界在公共工程项目,契约方面以及非正式实施方面的研究内容,然后基于契约的不完全性,有限理性,交易成本和委托代理理论,详细的阐述了公共工程项目的非正式实施从最开始项目的确立,到选择非正式实施的实施主体,到最终公共工程项目的非正式实施履行的运作过程。结合M公司在地下综合管廊中的实施案例,深入的分析了在公共工程项目非正式实施的过程中所存在的潜在隐患,同时也是对现有遵照契约文本实施项目制度的冲击,非正式实施的方式也会造成大家对于契约本身的轻视。在公共工程项目的非正式实施中还会易于滋生腐败现象。并且根据所出现的问题,本文还探究了产生公共工程项目非正式实施现象的原因,公共项目本身的特殊性,契约的不完全性,实施主体的局限性均会导致公共工程项目非正式实施现象的发生。所以,如何规避公共工程项目在非正式实施过程中所隐藏的风险,值得持续关注与深入思考。依据公共工程项目非正式实施所产生的问题,本文提出了一些优化策略,规范优化实施方的选择机制,建立非正式实施的问责机制,严格预防项目腐败行为的发生,从而降低公共工程项目非正式实施的风险。更多还原

【Abstract】 Government investment behavior has always been regarded as an important means to promote the country’s economic growth,therefore,reasonable and orderly increase of government investment can effectively promote economic growth.The new development concept of the new era,adhering to the quality first and benefit priority principles,which put forward more stringent requirements for the implementation of the current public works projects.Traditional public works projects are mainly realized through formal implementation,but due to the non-incompleteness of contract and environmental uncertainty and other factors,the implementation of public engineering projects will often go into the informal implementation path.Therefore,this paper focuses on observing the informal implementation of public works projects,hoping to explore the shortcomings and shortcomings of the existing contract system,and to provide reference for the improvement of the implementation system of public works projects.The informal implementation of public works projects,while saving costs and improving construction efficiency,is consistent with the ultimate goal set by the contract text,but at the same time there are various risks.This paper first reviews the current academic research content in public works projects,contracts and informal implementation,and then,based on the incompleteness of contract,limited rationality,transaction cost and principal-agent theory,expounds in detail the informal implementation of public works projects from the establishment of the initial project,to the selection of the implementation of informal implementation of the main body,The operational mechanism of the informal implementation of the final public Works project.Combining with the implementation cases of M company in Yinchuan Underground integrated pipe gallery,this paper analyzes in depth the potential hidden dangers in the process of informal implementation of public works projects,such as the lack of legal basis in the process of informal implementation of public works projects as a support,in the event of disputes will produce more unnecessary trouble.At the same time,it is also an impact on the existing implementation of the project system in accordance with the contract text,the non-formal implementation of the way will also cause everyone to despise the contract itself.Corruption can also be easily bred in the informal implementation of public works projects.And according to the problems,this paper also explores the reasons for the informal implementation of public works projects,the particularity of the public project itself,the incompleteness of the contract,the limitations of the implementation of the main body will lead to the phenomenon of informal implementation of public works projects.Therefore,how to avoid the hidden risks of public works projects in the process of informal implementation deserves sustainedattention and in-depth consideration.According to the problems arising from informal implementation,this paper puts forward some optimization strategies,standardizing the selection mechanism of the implementers,establishing the accountability mechanism of informal implementation,strictly preventing the occurrence of project corruption,and ultimately minimizing the risk of informal implementation of public works projects as far as possible.更多还原
