【摘要】 互联网租赁自行车,是共享经济的代表性产物,其绿色低碳、使用便捷、成本低、停放方便,能满足多元需求,解决了出行“最后一公里”的难题,这种出行方式被越来越多人选择,现在已成为公交、地铁之外被使用最多的交通方式。作为一种新生事物,互联网租赁自行车行业在迅速发展的同时也引发了许多问题,如互联网租赁自行车企业过量投放自行车,互联网租赁自行车用户随意停放互联网租赁自行车,互联网租赁自行车用户的押金及预付资金退还难等。因此,对互联网租赁自行车行政监管的立法完善进行深入研究,具有重要的理论意义和现实意义。本文首先对互联网租赁自行车行政监管的基本概念、特征及完善的必要性等进行了分析阐释。其次,对我国现有法律及规范性文件中涉及互联网租赁自行车行政监管的规定现状进行梳理,并分析了存在的问题,包括互联网租赁自行车企业市场准入条件不明确,互联网租赁自行车预付资金监管方式缺位,互联网租赁自行车企业退出条件不具体,缺乏政府部门与企业、社会组织协商合作机制。最后,从明确互联网租赁自行车市场准入条件,明确预付资金监管方式,细化互联网租赁自行车企业退出条件,建立政府、企业和社会组织协商合作机制等方面,提出了完善互联网租赁自行车行政监管立法的对策建议。更多还原

【Abstract】 Internet bicycle rental is a representative product of shared economy.Its green,low-carbon,convenient use,low cost,convenient parking,can meet multiple needs,and solve the problem of "the last kilometer" of travel.This mode of travel has been chosen by more and more people,and has now become the most used mode of transportation outside the bus and subway.As a new thing,the rapid development of the Internet bicycle rental industry has also caused many problems,such as the excessive use of bicycles by Internet bicycle rental enterprises,the free parking of bicycles by Internet bicycle rental users,the difficulty of refunding deposits and prepaid funds of Internet bicycle rental users,etc.Therefore,it is of great theoretical and practical significance to make a thorough study on the legislative perfection of the administrative supervision of Internet rental bicycles.Firstly,this paper analyses and explains the basic concepts,characteristics and the necessity of perfecting the administrative supervision of Internet bicycle leasing.Secondly,it combs the current situation of the regulations concerning the administrative supervision of Internet bicycle leasing in the existing laws and normative documents of our country,and analyses the existing problems from the aspects of the subject,scope and mode of the administrative supervision of Internet bicycle leasing,including the unclear market access conditions of Internet bicycle leasingenterprises and the absence of the supervision mode of Internet bicycle prepayment funds.The withdrawal conditions of Internet bicycle rental enterprises are not specific,and there is a lack of consultation and cooperation mechanism between government departments,enterprises and social organizations.Finally,from the aspects of defining the market access conditions of Internet bicycle rental,defining the supervision mode of prepaid funds,refining the withdrawal conditions of Internet bicycle rental enterprises,and establishing consultation and cooperation mechanism among government,enterprises and social organizations,this paper puts forward some countermeasures and suggestions for perfecting the legislation of administrative supervision of Internet bicycle rental.更多还原
