【摘要】 通过分析我国村镇银行法律监管的现状,并借鉴国外相关监管制度的立法特点和运作现状来提出符合我国村镇银行法律监管制度的完善建议。具体包括引言和结语在内分为六部分,引言是从整体上将村镇银行法律监管这一问题的研究背景和研究意义做出概述,并对国内外对村镇银行监管法律制度的相关研究做了综述。正文第一部分系统分析我国村镇银行自身的风险特殊性,并对其监管必要性做了简要分析。第二部分立足我国村镇银行监管法律体系的现状,通过对我国村镇银行监管法律体系和法律监管制度的机制分析,进一步得出我国村镇银行监管机制存在的缺陷。第三部分从村镇银行法律监管的现实需求入手,通过介绍和比较分析国外相关监管法律制度的分析,提出我国村镇银行法律监管整体架构的选择。第四部分是针对村镇银行的法律监管中出现的问题提出完善建议,包括监管主体的重新界定即构建多层次监管主体的结构、村镇银行监管立法体系的单独构建、发起人资格的扩张和业务范围的分级监管、以农民权益的优先保障为中心的村镇银行退出机制的构建。最后在结语和展望中对全文进行总结,并表达了对我国农村金融事业尤其是村镇银行的可持续发展的期望。更多还原

【Abstract】 By analyzing the current situation of supervision legislation of rural bank in China,and drawing lessons from the legislative characteristics and operation status of foreign relevant regulatory system to put forward suggestions to improve the legal supervision system of rural bank in China.Including the introduction and conclusion,this paper is divided into six parts.The introduction makes a rough statement to the research value and background of rural bank supervision system and the research on the supervision legal mechanism of rural bank at home and abroad.The first part of the paper systematically analyzes the specificity of the risks of the rural bank in China,and makes a brief analysis of the necessity of its supervision.The second part is based on the status quo of the supervision legal mechanism of rural banks in China,and the paper further draws the shortcomings of the supervision mechanism of rural banks through the analysis of the mechanism of banking supervision system and legal supervision system.The third part starts from the realistic demand of legal supervision of rural bank,and introduces the comparative supervision legal mechanism of foreign countries and puts forward the overall structure of legal supervision of rural bank in China.The fourth part is to make suggestions on the problems in the legal supervision of rural bank,including the re-definition of the subject of supervision,that is,the construction of the multi-level supervision subject,the separate construction of the supervision legislation system,the expansion of the sponsor qualification,the hierarchical supervision of the business scope,the building of the rural bank exit mechanism concentrating on the protection of farmers.Finally,the paper summarizes the whole paper with conclusion and prospect,and expresses the expectation of the sustainable development of China’s rural financial industry,especially the rural bank.更多还原
