【摘要】 矿产资源往往赋存于土地之中,对其进行勘探、开采,不可避免地会涉及到土地的使用问题。但是,矿业权本身并不包含土地使用权,因此,要合法地在土地之上进行矿业活动,就必须再取得以土地为客体的土地使用权。在我国,随着市场经济的不断发展,矿业权与土地使用权的权利主体二元性所造成的的冲突愈演愈烈,矿地矛盾突出,对社会的和谐稳定造成了消极影响。论文对矿业权与土地使用权的概念进行了界定,并指出我国矿业权与土地使用权的法律规范不足之处。根据我国的国情,系统地分析了我国矿业权与土地使用权在矿业用地取得、使用、流转及退出阶段所具有的冲突表现形式,得出矿业用地法律规范的缺位是造成权利冲突的直接原因,而复杂的土地权利结构层次则是造成权利冲突的根本原因。论文总结、借鉴国外在协调矿业权与土地使用权冲突方面各具特色的法律制度,并根据我国国情,提出在坚持公平、节约与集约用地、生态保护优先等价值原则的指导下,通过构建临时用地制度、股份合作制度以及矿业地役权制度等创新性的矿业用地制度来协调解决我国矿业权与土地使用权之间的冲突。更多还原

【Abstract】 Mineral resources are often deposited in the land.If they are explored and mined,they must use the land.However,mining rights do not include the right to use the land.Therefore,if you want to legally use the land,you must obtain the right to use the land as an object.But in our country,with the development of market economy,the conflict between mining right and land use right subject is becoming more and more serious,and the contradiction of mine land is prominent,which has a negative effect on the social harmony and stability.This paper defines the concept of mining right and land use right,and points out the inadequacy of the legal norms of mining right and land use right in China.According to the National conditions of our country,this paper systematically analyzes the form of conflict between mining right and land use right in the stage of acquisition,use,circulation and exit of mining land,and concludes that the lack of legal norms on mining land is the direct cause of the conflict of rights.The complex structure of land rights is the root cause of the conflict of rights.To sum up and draw lessons from the legal systems of various countries that deal with conflicts between mining rights and land use rights,and,according to China’s National conditions,put forward guidance based on the principles of fairness,conservation,intensive land use,and ecological protection.The conflict between mining right and land use right in China is resolved through the construction of the system of temporary land use,the system of share cooperation and the system of mining easement.更多还原
