【摘要】 现代物流业目前已经发展成为21世纪的重要产业,是在市场经济发展到精细化、专业化程度之后所出现的一种跨行业、跨地区、跨部门的综合性、基础性、服务型新兴产业,是也是新时期我国重点发展的产业之一。内河航运物流作为国民经济的重要组成部分,涉及领域广、吸纳就业人数多、促进了社会生产、拉动了国民消费,在促进产业结构调整、转变经济发展方式和增强国家经济竞争力等方面也起到了一定的积极作用。然而中国的物流行业因为起步较晚,内河航运物流发展相对滞后,在激烈的国际化竞争中优势不是很明显,因此从国家层面出台相应的法律法规对其发展进行扶持和保驾护航是非常有必要的。我国有着四通八达的内河航运网,有些河流还同一些邻国国际河流相连,先天的环境优势为货物进出口通过河流运输提供了十分便利的条件。随着全球运输服务行业进入综合物流时代,内河航运和物流业的发展紧密相联、相互促进。内河航运作为全球综合运输系统中的重要环节,已经成为物流产业链上一个组成部分,物流业发展离不开内河航运服务,而物流业兴盛与发展又为内河航运的进一步发展创造了新的机遇。自改革开放以来,我国内河航运物流得到了长足的发展,但是总体发展水平仍然偏低,还存在一些突出问题,法律法规的不健全就是其中之一。本文详细剖析我国内河航运物流领域法律法规现状,同时在借鉴欧美国家先进经验和做法的基础上,立足我国物流业发展趋势,提出了若干完善我国内河航运物流领域法律法规的建议。更多还原

【Abstract】 The logistics industry has become an important industry in the 21 st century,modern logistics industry is the development of a market economy to the fine,the degree of specialization appears after emerging industries,is a cross-industry,cross-regional,cross-sectoral comprehensive,fundamental,service-oriented industry,but also one of the new era of focus on the development of industry,to become the new commanding heights of national economic competition.The logistics industry is an important part of national economy,involving a wide area to absorb more employment,boost production and stimulate consumption big role plays an important role in promoting industrial restructuring,transformation of economic development and enhance the competitiveness of the national economy.However,the late start to the Chinese logistics industry,there is no advantage at all in the fierce international competition.The reason,many problems of logistics legal system exists is unavoidable.This paper analyzes the status quo of China’s logistics laws and regulations in other countries learn from the advanced ideas of legislation is proposed based on a number of logistics to improve the legal system recommendations.Building a sound legal system of logistics,in order for the vigorous development of the logistics industry escort.China is not only easily accessible by inland shipping networks,but also with a number of neighboring countries connected to international rivers,which for mutual import and export goods to provide a very favorable conditions through river transport and distribution.With the global transport services into the era of integrated logistics,and the development of inland logistics complementary and mutually reinforcing,inland transportation as a global integrated network in key areas,it can be said,inland logistics chain is a very important part of the logistics do not carry away open inland services,the rise and development of the logistics industry has created new opportunities for the further development of the inland.Since the reform and opening up,China’s inland logistics industry has been considerable development.But the overall level is still low,there are still some outstanding issues,imperfect laws and regulations is one of them.Based on the review of the existing laws and regulations on the logistics,the logistics of the river on the line legal research article.A brief analysis of the shortcomings of China Inland Logistics legislation,by contrast with the legislative experience of developed countries logistics,combined with several major development trend of the logistics industry,to China inland logistics legislation put forward their own proposals.更多还原
