【摘要】 21世纪随着中国经济飞跃式的发展,民众生活水平日益提高,同时对居住环境也有了更高的要求。近年来国内环境类群体性事件频发,造成了严重的社会影响,也创伤了政府公信力,逼迫政府必须抛弃传统管制思维,合法运用好中国特色社会主义民主制度,提升民主治理水平,有效预防和应对环境类群体性事件的发生。因此,充分研究环境类群体性事件发生的原因和应对策略对优化政府管理体制、转变政府执政观念、创新政府治理模式、真正做到“从群众中来到群众中去”具有重要的理论和现实意义。本文通过对L市反核事件的阐述与分析,在对社会主义民主制度探究的基础上,结合对法国、美国、瑞典等国家在核能开发、利用和处理方面相关法律与监管制度的研究,分析他们如何应对核能建设项目伴随产生的“邻避效应”,从而分析L市反核事件发生前后地方政府在管理上存在的忽视民众知情权与决策权、缺乏补偿机制、沟通机制不完善,以及没有充分利用好政务公开、听证、信访等我国民主协商机制而产生的相关问题,并根据分析出的问题从源头预防、应急处理、建立补偿机制等方面对我国环境群体性事件的预防与应对提出意见和建议,从而推动环境群体性事件的有效解决。更多还原

【Abstract】 In the 21st century,with the rapid development of China’s economy,people’s living standards have been increasing,and at the same time,there are higher requirements for the living environment.In recent years,domestic environmental group incidents have occurred frequently,causing serious social impacts and traumatic government credibility,forcing the government to abandon traditional regulatory thinking,legally applying the socialist democratic system with Chinese characteristics,improving the level of democratic governance,and effectively preventing and Respond to the occurrence of environmental group events.Therefore,it is of great significance to study the causes and coping strategies of environmental group events to optimize the government management system,change the concept of government governance,innovate the government governance model,and truly "go to the masses from the masses" significance.Through the exposition and analysis of the anti-nuclear incident in L City,this paper analyzes the research on the socialist democratic system and combines the research on the legal and regulatory systems related to the development,utilization and treatment of nuclear energy in France,the United States,Sweden and other countries.How to deal with the "neighborhood effect" accompanying the nuclear energy construction project,and analyze the local government’s neglect of the public’s right to know and decision-making,lack of compensation mechanism,imperfect communication mechanism,etc.before and after the L-counter anti-nuclear incident Relevant issues arising from China’s democratic consultation mechanism,such as open government affairs,hearings,letters and visits,and opinions and suggestions on the governance of environmental group incidents in China from the aspects of source prevention,emergency response,and establishment of compensation mechanisms.Promote an effective solution to environmental group events.更多还原
