【摘要】 当前中国以创新驱动战略推动新经济发展,知识产权发挥着越来越重要的作用,是国家发展的战略性资源和国际竞争力的核心要素。近年来,以商标、专利为主的知识产权数量快速增长,伴随着这种快速增长,知识产权交易市场也日趋活跃。尽管如此,知识产权价值评估作为知识产权交易的最关键一环,其评估能力薄弱、评估方法单一,严重制约着知识产权交易市场的快速发展,出现了“沉睡专利”等突出问题。因此,对知识产权价值评估及基于价值评估的交易策略进行研究,以促进知识产权转化具有重大意义。本文以知识产权交易、知识产权价值评估方法的基本理论为起点,通过对商标交易、专利交易价值评估研究,对知识产权交易中的价值评估及相应交易策略进行了深入研讨。首先,梳理知识产权评估理论中的成本法、市场法、收益法和期权法,分析了各自的适用性及缺点,并简要分析知识产权交易的对象与方式。接着,基于中华商标超市网的商标交易数据,分析了市场法的适用性,并提出商标交易策略。随后,基于专利价值评估影响因素、中美专利价值评估应用,分析了收益法的适用性,并提出专利交易策略。最后基于知识产权交易中的价值评估研究,提出了知识产权交易策略建议。本文的研究结论与建议主要有以下三点。(1)推进价值评估的智能化。在构建知识产权价值评估模型的基础上,通过知识产权历史交易的大数据,建立相应价值评估系统;推进价值评估的智能化,即构建智能化价值评估系统。在系统中输入待评估知识产权的相关信息后,由系统得出知识产权的评估价值。在系统的持续使用过程中,基于新的知识产权交易数据和实践经验,系统得以持续优化和完善。(2)选择合适的评估方法。对知识产权价值进行更准确评估,能够引导知识产权交易双方的价格预期,进而促成交易,而价值评估的关键是选择合适的评估方法。通过全文的研究,对成交相对活跃,有大量历史成交数据可供参考的商标交易,可采用市场法。对价值影响因素多且复杂,而现金流和剩余经济寿命相对容易确定的专利,可采用收益法。(3)探索多种交易方式。不同交易方式具有不同的特征和适应性,因此,需要探索多种交易方式。同时,多种交易方式得到的成交价格,又会反过来促进知识产权价值评估研究,并有助于价值评估系统的优化和完善。具体而言,对大部分知识产权交易,可以选择协议方式;对于稀缺和高价值知识产权,可以选择拍卖方式;同时,还可以通过发布专利方面的技术需求信息,探索招投标方式。更多还原

【Abstract】 At present,China has made an innovation driven strategy to promote the development of the new economy.Intellectual property plays an increasingly important role,and it is also a strategic resource for national development and a core element of international competitiveness.In recent years,the volume of patents and trademarks has increased rapidly.With this rapid growth,the intellectual property transaction market is becoming more and more active.However,as the key link of intellectual property transaction,the evaluation of intellectual property is weak and the method of evaluation is scarce,which seriously restricts the rapid development of intellectual property transaction market,and the outstanding problems such as "sleeping patent" have appeared.Therefore,it is of great significance to research the evaluation of intellectual property and the transaction strategy based on the evaluation to promote the transformation of intellectual property.Starting from the theory of intellectual property transaction and the method of evaluation of intellectual property,this thesis makes the discussion on the value evaluation and corresponding transaction strategy in the intellectual property transaction through the research of the value evaluation of the trademark and patent transaction.First of all,it combs the the theory of intellectual property evaluation,including cost method,market method,income method and option method,analyzes their respective applicability and shortcomings,and analyse the object and pattern of intellectual property transaction.Then,based on the trademark transaction data of China Trademark Supermarket,analyse the applicability of the market method,and put forward the trademark transaction strategy.Next,based on the influencing factors of patent value evaluation and the application of China and U.S.patent valuation,analyse the applicability of the income method,and propose the patent transaction strategy.Finally,put forward suggestions for transactions strategies in intellectual property transactions.There are three conclusions and suggestions in this thesis.(1)Promote theintelligentization of value evaluation.On the basis of constructing the value evaluation model of intellectual property,the corresponding value evaluation system is established through the big data of historical intellectual property transaction.The intellectualization of the value assessment is to build an intelligent value assessment system.After input the relevant information of intellectual property to be evaluated in the system,the evaluation value of the intellectual property is obtained by the system.In the continuous use of the system,the system is continually optimized and improved based on the new data and practical experience in intellectual property transactions.(2)Select the appropriate evaluation method.A more accurate evaluation of the value of intellectual property can guide the price expectations of both parties in intellectual property transaction and facilitate the transaction.The key to the evaluation is to choose the appropriate evaluation method.Adopt the market method to deal with trademark transactions which are relatively active and have a large number of historical transaction data for reference.There are many factors that affect the value of patent,and the income method can be used to determine the cash flow and the remaining economic life of the patent.(3)Explore a variety of transaction methods.Different transaction modes have different characteristics and adaptability,so it need to explore a variety of transactions.At the same time,the transaction price obtained by various transaction methods will in turn enrich the research on the value evaluation of intellectual property,and it can contribute to optimize and improve the value evaluation system.For most intellectual property transactions,it is possible to choose the negotiation transaction;for the scarce and high value intellectual property,the auction method can be selected;meanwhile,the bidding transaction can be explored by publishing the technical requirements information about patent.更多还原
