构建呼伦贝尔市行政复议委员会制度的思考

【摘要】 近年来,呼伦贝尔市行政复议规范化建设初见成效,行政复议水平逐步提高,化解社会矛盾纠纷的作用明显,但与呼伦贝尔的各项社会事业发展速度比较,行政复议工作的发展仍然相对滞后。目前现状看,呼伦贝尔市行政复议制度仍存在的定位模糊、人员不足、机构不全、制度不完善等问题,仍存在行政复议机关有案不敢接、不能接,接了不会办,撤销会与维持会并存的现象。随着我市行政复议案件数量大幅增加,案件类型的错综复杂以及化解社会矛盾纠纷的迫切需求,急需我们探寻现有行政复议体制的不足,并提出解决对策。我国通过多年的理论研究与实践,行政复议委员会制度不断发展与成熟,呼伦贝尔市可以通过构建行政复议委员会制度,实现行政复议体制的变革,解决目前的相应问题。本文通过概述我国行政复议委员会制度基本内容,在探讨我国行政复议委员会制度的发展现状及国外先进经验的基础上,重点论述构建呼伦贝尔市行政复议委员会制度的意义与内容,最后,提出加强和完善呼伦贝尔市行政复议制度的建议。更多还原

【Abstract】 In recent years,the standardization of administrative reconsideration in Hulunbeir City has achieved initial results.The quality of administrative reconsideration personnel has been gradually improved.The role of resolving administrative disputes and resolving social contradictions is obvious.However,compared with the development speed of various social undertakings in Hulunbeir City,the development of administrative reconsideration is still relatively lagging behind.There is room for further improvement in resolving the important role of social disputes.At present,there are still some problems in Hulunbeir administrative reconsideration system,such as ambiguous orientation,insufficient personnel,incomplete organization,imperfect system and so on.There are still some problems in the administrative reconsideration organs,such as daring not to accept the case,unable to accept it,unable to handle it,and the coexistence of cancellation meeting and maintenance meeting.With the increase of the number of administrative reconsideration cases,the complexity of the types of cases and the urgent need to resolve social contradictions and disputes,it is urgent for us to explore the deficiencies of the existing administrative reconsideration system and propose solutions.Through years of theoretical research and practice in China,the administrative review committee system has been developing and maturing.Hulunbeir City can realize the reform of the administrative review system and solve the corresponding problems by constructing the administrative review committee system.This paper summarizes the basic contents of the administrative reconsideration committee system in China,discusses the advanced experience abroad,and focuses on the significance and content of constructing the administrative reconsideration committee system in Hulunbeir City.Finally,it proposes to strengthen and improve the administrative reconsideration in Hulunbeir City.Proposals for the system.更多还原
