【摘要】 近年来,全国旅游纠纷频发,对旅游业的健康发展造成严重影响。全国各地开始探索通过建立旅游纠纷人民调解机制来解决旅游纠纷。海南省海口市成立了全国首家旅游纠纷人民调解委员会(以下简称“旅调委”),有效缓解了旅游纠纷引起的矛盾。三亚市不断创新旅游纠纷人民调解机制,并形成了独具特色的“三亚模式”。其他省市也积极进行地方探索,并取得了良好效果。将各个地方探索汇总整理,可以总结出旅游纠纷人民调解机制运行的经验,包括保证调解组织的中立性、明确调解范围、保证调解工作的专业性和建立“三调联动”工作机制。但是在实际运作中也暴露出相关立法不完善、未建立系统的旅游纠纷人民调解体系、相关配套措施不完善、调解队伍人才匮乏等一系列问题。为此,应当完善相关立法,构建系统的旅游纠纷人民调解体系,加强旅游纠纷人民调解队伍建设,完善相关配套措施,包括在旅调委下设立专门的司法确认机构和执行机构、建立网上调解制度。通过完善旅游纠纷人民调解机制,让其在解决旅游纠纷方面发挥更大的作用,从而促进旅游行业稳定、健康的发展。更多还原

【Abstract】 In recent years,the frequent occurrence of tourism disputes throughout the country has seriously affected the healthy development of tourism.People’s mediation mechanism of tourism disputes has been explored to solve tourism disputes in the whole country.The first national people’s mediation committee for tourism disputes was established in Haikou City,Hainan Province(hereinafter referred to as tourism mediation committee),which effectively alleviates the contradictions caused by tourism disputes.Sanya continuously innovates the mediation mechanism of tourism disputes,and forms a unique "Sanya model".Other provinces and cities also actively carried out local exploration,and achieved good results.The experience of the operation of the people’s mediation mechanism for tourism disputes can be summed up by aggregating the exploration of each local exploration,including ensuring the neutrality of the mediation organization,clarifying the scope of mediation,ensuring the professionalism of mediation and establishing the working mechanism of "The Effective Connection of the Three Modes of Mediation ".But a series of problems have also been exposed in practice,including the related legislation is not perfect,the people’s mediation system of tourism disputes is not established systematically,the relevant supporting measures are not perfect and the talent of mediation team is scarce,etc.Therefore,the relevant legislation should be perfected,the systematic system of people’s mediation in tourism disputes should be constructed,the construction of people’s mediation teams in tourism disputes should be strengthened,and the relevant supporting measures should also be improved,including the establishment of specialized judicial confirmation agencies and enforcement agencies,the establishment of online mediation system under the Tourism mediation committee.The people’s mediation mechanism of tourism disputes can play a greater role in solving tourism disputes by perfecting the people’s mediation mechanism of tourism disputes so as to promote the stable and healthy development of tourism industry.更多还原
