【摘要】 政府补贴在我国是十分普遍的现象,是我国政府干预国民经济运行,进行宏观调控的重要手段。在克服市场失灵方面,政府补贴发挥着十分显著的作用。然而,由于缺乏完备有效的法律法规对政府补贴进行规制,政府补贴的负面作用也十分明显,尤其是地方政府对本地企业的偏好性补贴,可能对市场的公平竞争秩序产生破坏作用。因此,有必要建立适当的法律制度对政府补贴进行有效规制,使其在不损害整体公平竞争秩序的情况下,发挥最大的功效。2016年6月14日,国务院下发了《关于在市场体系建设中建立公平竞争审查制度的意见》的通知,这标志着公平竞争审查制度在我国的正式确立,这对于规制行政垄断行为具有标志性的意义。本文通过学习和借鉴已有的关于政府补贴的公平竞争审查方面的研究成果,遵循提出问题、研究问题、解决问题的研究思路,探讨运用公平竞争审查制度对政府补贴进行有效规制的问题。首先,本文对政府补贴的概念以及公平竞争审查制度的概念进行阐述,分析我国政府补贴产生的效应,笔者认为有必要建立对政府补贴行为的公平竞争审查机制,以有效规制政府补贴行为;其次,本文对欧盟国家援助的制度体系和特殊规则进行阐述,笔者认为欧盟在立法体系的完备性、建立统一执法机构、倡导竞争优先等方面可为我国提供有益的借鉴;再次,本文对我国目前政府补贴公平竞争审查的规制现状及问题进行分析,笔者认为目前的规制制度很不完善,在立法、执法、监督环节都存在欠缺;最后,本文从我国实际出发,提出完善政府补贴公平竞争审查制度的建议。笔者认为,应当修改《反垄断法》,将政府补贴的公平竞争审查制度写入该法,同时应将国务院反垄断委员会作为统一的反垄断执法机构,并由其发布具体的指南指导执法工作,并有必要倡导竞争优先的政策。更多还原

【Abstract】 Government subsidies is obvious in China’s economic performance,it has been an efficient instrument of government intervention.Government subsidies contribute a lot to the rapid progress of many undertakings and our economy.But due to lack of regulations and provisions,government subsidies have been abused,which distort fair competition and do harm to allocation efficiency and consumer welfare.Especially for the regional government subsidies,which often conferred to local undertakings,give disadvantages to other competitors in the related internal market.The State Council has announced a document to establish our own fair competition review system,it’s a great step to regulate administrative monopoly,including government subsidies.First,this thesis tries to elaborate the concept of government subsidies and fair competition review system.Second,it tries to introduce EU’s state aid system,both its substantial rules and procedural rules,so as to provide institutional experiences for our countries’ relative legislation.Third,it tries to describe the current situation of government subsidies regulation through fair competition review system,and the necessity to reform and perfect the system.Finally,it tries to give some suggestions to perfect our fair completion review system,so as to regulate government subsidies effectively.更多还原
