【摘要】 公平正义是我国社会主义法治的目标追求。维护并实现公平正义是包括法院和检察院在内的司法机关的首要职责和神圣使命。司法具有公信力,才能增强公众对司法的信任和对法律的信仰,才能树立司法权威,才能保证司法价值得以充分实现,才能充分保障社会的公平和正义。司法公信力是社会公众对司法机关和司法机关行为的认同、满意和信任程度。它是法治社会的基石,是衡量法治文明程度和社会文明进步的一个基本标尺。检察机关作为我们国家重要的司法机关,承担着维护社会主义法律制度统一、尊严和权威的社会责任和重要使命。检察机关司法公信力,是检察机关在行使法律监督权、履行法律监督职责的过程中对社会公众的信用和社会公众对检察机关及其行为过程和结果的普遍尊重与信任,以及在此基础上形成的检察机关及检察权行使行为的权威性和影响力。检察机关作为国家的法律监督机关,其司法公信力具有提升司法权威、维护社会秩序、培养法治信仰、促进法治发展的功能。在经济社会高速发展、法治化逐步推进的社会背景下,在各种新型的社会问题、社会纠纷不断涌现的现实下,人民群众的司法需求和对司法的关注日益增长。近年来,检察机关不断创新工作理念和模式,立足民生,服务大局,强化内外部监督制约机制,开展了规范司法行为、深化检务公开、司法公信建设年等系列专项活动,使检察工作更加科学、规范、透明、公正,赢得了社会公众的认同和肯定。与此同时,诸如检察权行使的地方化和行政化、司法不公不廉现象的存在、检察队伍少数人员素质不高、部分涉检信访处理不当、处理社会舆情能力不强等检察机关司法公信力建设中存在的问题也引起检察机关和社会的重视。检察机关如何提升自身司法公信力,增强社会公众对检察机关及其司法行为的信赖和尊重,真正树立起检察机关在人民群众心目中的权威,是当前重要而紧迫的战略任务。建设与提升检察机关司法公信力,这是检察机关的一项重点工作、也是一项综合性强的系统化工作,既需要各级检察机关和检察人员的努力,同时又需要社会各界和人民群众的理解与支持,既需要科学完善的体制制度和工作制度,也需要良好的法治大环境。针对检察机关司法公信力建设中存在的问题及其分析,结合当下司法体制改革的背景,提升检察机关司法公信力有六条具体路径:推进检察改革确保检察权独立公正行使,加强队伍专业化建设提高法律监督能力和水平,全面规范履职确保公正高效司法,完善监督制约机制确保检察权规范合法行使,践行司法为民理念确保服务民生民利,推进检务公开确保检察权在阳光下运行。随着司法体制改革的逐步深入推进,社会主义司法制度的逐步完善,精准对接实践需求的检察体制改革,能够更加适应当今形势下的司法实践,促进检察工作的开展,提升办案质量、办案效率和办案效果,提升检察机关司法公信力。更多还原

【Abstract】 Fairness and justice are the goal of socialist rule of law in our country.To safeguard and realize fairness and justice is the primary duty and sacred mission of the judicial organs,including the courts and procuratorates.The judicature has the public trust,can enhance the public trust in the judiciary and the belief in law,can establish judicial authority,can ensure judicial value can be fully realized,can fully protect the social fairness and justice.The judicial public trust is the approbation,satisfaction and trust of the public to judicial organs and judicial organs.It is the cornerstone of a society ruled by law and a basic yardstick for measuring the level of civilization in the rule of law and for the progress of social civilization.As the important judicial organ of our country,procuratorial organs bear the social responsibility and important mission of safeguarding the unity,dignity and authority of the socialist legal system.Procuratorial organ judicial credibility,is the procuratorial organ in exercise legal supervision and legal supervision responsibilities in the process of public credit and the social public to society and its behavior of procuratorial organ process and result of universal respect for and trust,and on the basis of the formation of the procuratorial organs and procuratorial authority and influence of exercise behavior.As the legal supervision organ of the state,the judicial public trust of the procuratorial organ has the function of promoting judicial authority,maintaining social order,fostering the belief in law and promoting the development of the rule of law.Step by step in the rapid development of economy and society,the rule of law under the social background,with the continuous emergence of new social problems and social disputes in reality,people’s demand for justice and judicial attention increasingly.In recent years,the procuratorial organs innovative concepts and models,based on the work of the people’s livelihood,serving the overall situation,strengthen internal and external supervision mechanism,carry out the norms of judicial conduct,deepening making public,public confidence in the judicial building and other special activities,make procuratorial work more scientific,standardized,transparent and fair,won the recognition of the public and sure.At the same time,the existence of local and administrative and judicial injustice,not cheap phenomenon of procuratorial power such as the existence,the prosecution team of minority personnel quality is not high,part of the petition,the improper handling of social public opinion ability of procuratorial organs in the construction of the judicial credibility problems caused by the procuratorial organs and the attention of the society.The procuratorial organs should enhance their own judicial credibility,enhance the public trust of the procuratorial organs and the judicial behavior and respect,establish a procuratorial authority in the eyes of the people,is an important and urgent strategic task.Construction and enhance the credibility of the prosecution,it is a key work,the procuratorial organ is a comprehensive work,both prosecutors and prosecutors at all levels of effort,but also need understanding and support of the community and the people,not only need to improve the system and work system of science also,need good environment of law.According to the analysis and construction of procuratorial organs in the judicial credibility problem,combined with the current background of judicial reform,enhance the credibility of the judiciary the procuratorial organ has six ways: promote judicial reform to ensure independent and impartial exercise of prosecutorial power,strengthen the construction of professional team to improve the ability and level of legal supervision,to ensure fair and efficient judicial duties fully standardized,perfect the supervision mechanism to ensure the legitimate exercise of prosecutorial power standard,practice the ideal of justice for the people to ensure that the service concerning people’s livelihood,promote the public to ensure the operation of procuratorial power in the sun.With the advancement of the judicial system reform,socialist judicial system gradually perfect,precise docking practice requirements of the procuratorial system reform,to adapt to the situation of the judicial practice,promoting procuratorial work,improve the quality of case handling,handling efficiency and handling effect,enhance the credibility of the prosecution.更多还原
