道路交通事故损害赔偿责任主体及归责原则研究

【摘要】 随着我国的公路建设和机动车的快速发展,交通事故的发生率每年都保持一定程度的增长。这严重危害到人民的生命健康及财产安全,因道路交通事故引发的损害赔偿纠纷也与日俱增。作为侵权法律责任方面的主要问题,道路交通事故损害赔偿一直广受人民的关注。本文主要探讨了道路交通事故损害赔偿主体、归责原则并分析了我国道路交通事故损害赔偿责任主体及归责原则尚存在的不足之处,提出完善的建议。除引言和结论外,正文内容共分为三章。第一章题为“道路交通事故损害赔偿责任主体”该章节主要介绍了国内外道路交通事故损害赔偿责任主体的认定,通过细分道路交通事故损害赔偿责任主体的范围,分别阐述了道路交通事故责任的一般主体和特殊主体的相关内容,并分析了当前我国道路交通事故损害赔偿责任主体的认定存在的问题。第二章题为“道路交通事故损害赔偿责任的归责原则”。该章通过对国外道路交通事故损害赔偿归责原则的相关立法进行比较和借鉴,介绍了我国道路交通事故损害赔偿归责原则的立法演变过程。第三章题为“对道路交通事故损害赔偿制度的几点建议”。针对我国道路交通事故损害赔偿立法所存在的缺陷进行分析,并提出几点建议。更多还原

【Abstract】 With the rapid development of road construction and motor vehicle in China,the incidence of traffic accidents has maintained a certain degree of growth every year.As the main problem of tort liability,road traffic accident damage compensation has been widely concerned by the people.This paper mainly discusses the road traffic accident damage compensation subject,imputation principle and compensation scope and standards,and analyzes the road traffic accident damage imputation principle still exist deficiencies,put forward the perfect proposal.Inaddition of foreword and conclusions,the article is divided into three chapters.he first chapter is entitled "Overview of the Basic Problems of Road Traffic Accident Responsibility" This chapter mainly introduces the concept of road traffic accidents and the main body of road traffic accidents.Through the scope of subcontractors,the general subjects of road traffic accident And the relevant content of the special subject.Chapter two is the "Principles of Liability for Damage to Road Traffic Accidents".This chapter compares and draws lessons from the relevant legislation on the principle of liability for damages for foreign road traffic accidents,and introduces the legislative evolution of the principle of liability for compensation for road traffic accident.Chapter three is entitled "Scope and Criteria for Damage Compensation for Road Traffic Accidents".This chapter mainly introduces the scope and standard of liability for road traffic accident damage,and discusses the problem from three aspects: personal injury compensation,property damage compensation and mental damage compensation in road traffic accident.Chapter four of the "road traffic accident damage compensation system,a few suggestions."
