【摘要】 网络刷单行为的出现是网络交易发展中的意外产物,但是却伴随着网络交易的迅速发展和不断变化,网络刷单行为的模式也不断升级变化,其以获得不正当竞争优势或违法利益为目的,虚构交易,使网络交易市场有一种虚假繁荣的现象,对网络交易的长期健康发展不利,而且随着网络刷单数量的增加和网络刷单行为的组织性特征的凸显,其造成的社会危害性辐射范围变的更广,刑法有必要对其予以规制。在适用现行刑法对网络刷单进行规制的过程中,对部分网络刷单的具体行为规制理论上存在较大争议,如对虚假宣传行为的规制、对组织刷单行为的规制和对恶意好评行为的规制。针对争议的焦点找出刑法规制的不足,在坚持罪刑法定原则和刑法谦抑性原则的基础上,从司法层面提出完善虚假广告罪、非法经营罪、破坏社会主义市场经济罪司法解释的建议,对于通过解释仍然不能合理规制的,从立法层面,审慎设立新罪,借鉴国外相关立法,设立妨害业务罪。更多还原

【Abstract】 The appearance of brush single network behavior is accident result in the development of online transactions,but along with the rapid development of the network trading and changing,brush single network behavior patterns also escalating change,its for unfair competition advantage or illegal interests for the purpose of fictitious transactions,make the network market has a kind of false prosperity phenomenon,adverse to the long-term and healthy development of the network trade,and with brush brush list and an increase in the number of network organizational characteristics of single highlight,the scope of its social harmfulness caused by radiation become more wide,it is necessary for the criminal law to regulate.Brush list would be useful in current criminal law in network,in the process of regulating the network of some brush list specific behavior regulation is put in bigger dispute in theory,such as the false propaganda behavior regulation,to brush the single organization behavior regulation and regulation of malicious good behavior.Aiming at the shortcomings of the find out that the criminal law,adhere to the principle of a legally prescribed punishment and tolerance principle in criminal law,on the basis of the judicial forward some Suggestions to perfect the related judicial interpretation,from the legislative level carefully the establishment of the new crimes,to grasp the network brush single behavior of social harmfulness to prescribed accordingly change,brush to the network crimes of criminal law regulation of single behavior.更多还原
