【摘要】 近年来,我国校园欺凌现象日益突出,已经发展成社会各界广泛关注的热点与焦点问题。各种校园欺凌事件已经普遍地、不同程度地存在于我国各中小学,并被披露在社会媒体上。校园欺凌牵一发而动全身,它对于学生们的健康成长,对整个学校甚至是社会的治安稳定都有着极为重要的影响。美国从上个世纪起就重点治理校园欺凌问题,从1999年开始各州陆续制定了反欺凌法。至今50个州已全部出台反校园欺凌法,形成了相对完善的校园欺凌立法体系,对减少校园欺凌产生了的一定的效果。我国也逐渐认识到立法对于减少校园欺凌行为的重要性,认为应尽快立法,解决严重的欺凌问题。美国的这些实践对我国校园欺凌立法提供了可借鉴的经验,因此,对美国校园欺凌立法的研究具有重大的理论和实践价值。本文首先介绍了选题来源,阐述了研究校园欺凌立法的理论和现实意义及文章使用的两种研究方法——文献研究法和比较研究法,对“校园欺凌”进行了界定,从国内和国外两个方面分析了校园欺凌的研究现状。其次是对美国校园欺凌立法背景和发展的基本介绍,包括专门的校园欺凌立法出来之前的相关立法、各州校园欺凌立法的时间以及出台立法所产生的效果。然后论述了美国反校园欺凌法包括的三个主要部分,即校园欺凌概念的法律界定、校园欺凌的法律预防及校园欺凌的法律制裁。预防和制裁这两部分以最严厉、操作性最强的新泽西州反欺凌法为例来进行分析。再次,从特点和局限性两方面分析了美国校园欺凌立法。最后论述了美国校园欺凌立法对我国的启示。更多还原

【Abstract】 In recent years,the phenomenon of bullying in our country has become increasingly prominent,and it has become a hot issue and a focus of attention.All kinds of school bullying have been widely distributed in various degrees in primary and secondary schools and are revealed in the social media.Bullying on the school affects the whole body.It plays a very important role in the healthy growth of students and on the stability of the entire school and even society.Since the beginning of the last century,the United States has been focusing on the problem of bullying in schools.Since 1999,the states have successively formulated anti-bullying laws.Up to now,all50 states have issued anti-school bullying laws,forming a relatively perfect school bullying legislation system,which has a certain effect on reducing school bullying.Our country has also gradually realized the importance of legislation in reducing school bullying,and believes that legislation should be enacted as soon as possible to solve the serious problem of bullying.These practices in the United States have provided some experience for reference in the legislation of school bullying in our country.Therefore,the study of school bullying laws in the United States is of great theoretical and practical value.This paper first introduces the source of the topic,expounds the theoretical and practical significance of the research on school bullying legislation,and the two research methods used in the article—literature research method and comparative research method,define "school bullying",the present situation of school bullying is analyzed from domestic and foreign aspects.Secondly,it is a basic introduction to the background and development of the U.S.school bullying legislation,including the relevant legislation before the special school bullying legislation came out,the time of the state school bullying legislation and the effect of the legislation.Then the paper discusses the three main parts of the U.S.anti-school bullying law,namely the legal definition of the concept of bullying on school,the legal prevention of school bullying and the legal sanction of school bullying.The two parts of prevention and sanctions are based on the most stringent and highly operational New Jersey anti-bullying law as an example.Thirdly,the paper analyzes the US school bullying legislation in terms of characteristics and limitations.In the end,the paper introduces the enlightenment of the U.S.school bullying legislation to our country.更多还原
