【摘要】 非专利实施实体(NPE)是专利获取后的存在形态之一,它具有着不同于一般专利形态的“非应用性”,NPE的滥用形势严峻,同时成为专利市场的巨大威胁。然而,NPE的存在与发展可以通过专利制度发展特征加以追述,从而得出在发展过程中NPE存在的必然性。将NPE通过其目的性差异大致可区分为事实性NPE、潜伏型NPE、侵略型NPE三种,通过对不同种NPE的行为模式进行区分,能够细化NPE的存在形态,并有针对性的对其进行滥用分析和设置符合其特征的规制策略。通过细化和区分能够实现滥用程度与规制的严苛程度相匹配,同时能够实现利益的平衡,符合专利制度设定初衷。结合对NPE的分类研究,提出影响每种NPE的规制难度因素,能够更好地适应当今时代背景下的专利局势,提出对我国防御NPE滥用局势演变的合理化建议,有效促进我国专利市场的竞争实力,为我国企业走向国际化市场提供保障。更多还原

【Abstract】 Non-patented Entity,known as NPE,is a NPE form after obtaining the patent.Because o f the “non-application”,it is distinguished from other patent entity.Meanwhile,it became sev ere treat to the current patent market.However,the existent and development of NPE can be t raced through the development features of the patent system,as a result,it can be concluded t hat NPE is an necessity through the patent development process.It can be categorized into thr ee different type,Fact NPE,Insidious NPE,and Invasive NPE.First,we will be able to divide the existing forms of NPE into different segments through the categorize of NPE behavior m odels.Meanwhile,specific regulations and strategies can be applied to certain NPE categories.Secondly,the segmentation of the NPE forms will enable us to analysis the severity of amus ement and strictness of regulations.As a result,the goal of balancing the benefits is accomplis hed,which conforms to the purpose of the patent system.Lastly,in order to better adapt to th e current patent system,it is necessary to analysis the level of regulations according to the spe cific NPE classification.Also,based on the analysis through the process,we will be able to of fer reasonable suggestions to the revolution of NPE abuse.Meanwhile,it will promote the po wer of Chinese patent market and create opportunities for Chinese enterprises to merge into th e world market.更多还原
