历史法学与德意志统一

【摘要】 统一是国家历史的普遍结论,历史法学促进了德意志的统一进程。统一作为一种国家政治现象,并非只是政治势力之间的简单抗衡,统一的背后有以民族历史为基础的理论渊源。国家统一使命的完成,涉及到国家政权的延续性、实质性以及聚合性问题。在此基础上,本文对于德意志统一的历史分析遵循由具体到抽象再回到具体的原则,重点分析了罗马帝国、基督教、民族国家与德意志统一之间的关系,并提出了德意志两次统一的不同逻辑。历史法学产生于德意志统一进程之中,历史法学理论的形成在事实上必然要受其影响,这种影响事关德意志的统一。德意志的统一,其本质不在疆域,而在民族,民族的认同形成德意志统一的价值基础。历史法学作为一种知识上的觉醒,是这种价值基础的一个侧面,从法学角度对于凝聚德意志民族的认同意识做出了回应,这是历史法学对于德意志民族团结与统一进程作出的贡献。分析历史法学与德意志统一过程之间的关系问题,对于我们当下认识统一现象,认识法学,特别是看待法学在民族统一进程中所扮演的角色,是有帮助和启示的。本文共分四章,第一章主要探讨了统一理论,以及德意志民族的形成及其民族性;第二章着重从罗马帝国、基督教以及民族国家方面,分析了德意志统一相关联的影响因素;第三章分析了历史法学在德意志统一进程中的兴起,并对其理论背景、基础和逻辑作了简要分析;第四章重点从罗马法与民族性两个方面分析了历史法学与德意志统一之间的关系,并提出了历史法学研究对象上的自我收缩与理论更新的缺乏,进一步探讨了公法秩序与德意志统一之间的关系;第五章是本文的结束语。更多还原

【Abstract】 Unification is a general conclusion of national history,and historical law promotes the process of reunification of Germany.Unification as a national political phenomenon,not just a simple contend for political forces,unified behind the national history based on the theoretical origin.The completion of the national unity mission involves the continuity of the state power,substantive and polymerizational issues.On this basis,this article analyzes the relationship between the Roman Empire,the Christianity,the nation-state and the German reunification,and puts forward the relationship between the reunification of the German Empire.Historical jurisprudence arises from the process of reunification of Deutsche,and the fonnation of historical jurisprudence is in fact bound to be influenced by the unity of the will.The unity of Deutsche,its essence is not in the territory,and in the national,national identity formation of the unity of the value base of Germany.Historical jurisprudence,as a kind of intellectual awakening,is a side of this value base,and has responded to the connotation of the German nation from the perspective of jurisprudence.This is the contribution of historical jurisprudence to the process of national unity and unity of German.It is helpful for us to understand the phenomenon of reunification and understand jurisprudence,especially the role of law in the process of national reunification.This chapter is divided into four chapters,the first chapter mainly discusses the unified theory,and the formation of the German nation and its national character;The second chapter focuses on the influence factors of German reunification from the Roman Empire,Christianity and nation-state.The third chapter analyzes the rise of historical jurisprudence in the process of German reunification,and makes a brief analysis of its theoretical background,foundation and logic.The fourth chapter focuses on the relationship between historical law and German reunification from the aspects of Roman law and nationality,and further explores the unity of public order and German The relationship between;Chapter 5 is the conclusion of this article.更多还原
