【摘要】 腐败是社会毒瘤、权力之癌,全球公害,没有一个国家完全摆脱了腐败的困扰。中国共产党的性质和宗旨决定了其与腐败水火不容,中国共产党自成立伊始就制定了严格的党内反腐败法规,九十多年来逐渐形成完整、系统的预防和惩治腐败的党内法规体系,对于保持党的先进性和纯洁性,捍卫党的形象和权威发挥了重要作用。在全面推进依法治国、全面从严治党的背景下,中国共产党党内反腐败法规更是具有中国特色的反腐利剑,它在治理腐败的过程中不仅方式独特、效果显著,而且承载着重要的政治价值、法律价值、社会价值和时代价值。在党风廉政建设和反腐败斗争实践中存在的制度漏洞以及各地区执纪能力差异等原因导致党内反腐败法规出现诸如相关配套制度缺乏,部分党内反腐败法规质量不高,与国法契合度不高,重要领域党内反腐败法规建设不完善以及执行落实不足等问题,大大削弱其应有作用的发挥。为了充分发挥党内反腐败法规预防和惩治腐败的价值和功能应该通过废旧立新,提升其质量和严谨性;完善党内反腐败法规配套措施建设,增强其系统性;实现纪法分开,加强党内反腐败法规与国法之间的衔接协调;立足现实反腐需要,保障党内反腐败法规的针对性和有效性;提高执行力,确保党内反腐败法规刚性运行等措施进行完善,以期真正落实全面从严治党、全面依法治国,促进不敢腐、不能腐、不想腐的廉洁机制和良好政治生态环境的形成,建设廉洁政府。更多还原

【Abstract】 Corruption is a cancer of social,a cancer of power,Global problem,no country is completely free from corruption.The nature and purpose of the Chinese Communist Party determines it is absolutely incompatibility with corrupt.Since the founding of the Chinese Communist Party,it has formulated strict anti-corruption laws and regulations in the Party.In the past 90 years,the Chinese Communist Party has gradually formed a complete and systematic system of preventing and punishing corruption,playing an important role in maintaining the party’s advanced nature and purity and defending the party’s image and authority.Under the background of comprehensively promoting the rule of law and governing the party in an all-round way,the anti-corruption laws of the Chinese Communist Party are anti-corruption sword with Chinese characteristics.In the process of anti-corruption,it is not only unique,effective and important,but also has important political value,legal value,social value and the value of time.In the practice of party style and clean government and the practice of anti-corruption,for the existence of institutional loopholes and differences in the ability of different regions and other reasons led to anti-corruption laws emerge many problems:such as the lack of relevant supporting system,part of the internal anti-corruption laws and regulations are not high quality,the compatible with legal is not sufficient,the important areas of anti-corruption laws and regulations is not perfect and the implementation of anti-corruption laws is not ineffective,greatly weaken the role it should play.In order to make full use of the value and function of the anti-corruption laws and regulations of the party to prevent and punish corruption.We should reform the law and regulation to enhance its quality and rigor;improve the supporting measures of the anti-corruption laws and regulations,the supporting measures of the anti-corruption laws and regulations to enhance its systematic;achieve the separation of discipline and law enhance the conformity;based on the reality of anti-corruption needs to protect it’s relevance and effectiveness;Increase the degree of implementation to ensure that the anti-corruption laws and regulations more perfect.In order to real comprehensively governing the country in an all-round way and ruling of law to promote the mechanism If not dare to corrupt,can not corrupt,do not want to corapt,and the formation of good political environment,building a clean government.更多还原
