物业服务合同履行中业主抗辩权行使研究

【摘要】 近年来,物业服务合同纠纷已经成为民事纠纷的主要案由之一,并且呈逐年增长的趋势。物业服务合同纠纷虽然诉讼标的小,但是通常是“群体性”案件,如果不能妥善处理,极易引发激烈的社会矛盾,不利于社会主义和谐社会的构建。物业服务合同纠纷的通常表现形式为物业公司起诉业主要求其缴纳拖欠的物业服务费用,而业主则行使抗辩权对抗物业公司。因此研究物业服务合同履行中业主抗辩权的正当行使,可以有效地解决物业服务合同纠纷。绪论部分对研究背景及意义、研究方法进行了简要的阐述,说明了研究业主抗辩权行使的必要性及方法。第一章采用实证分析的方法对于我国物业服务合同履行过程中业主抗辩权行使的现状进行了考察。结合案例数据总结了业主抗辩权行使的特征、物业服务合同纠纷中业主抗辩的主要事由以及审判工作中的司法认定。通过列举典型案例的形式,发现在司法认定中,物业服务合同纠纷案件的同案不同判现象较为严重,引人思考,并且总结了物业服务合同纠纷案件多、业主行使抗辩权现象混乱的原因。第二章分析了物业服务合同的法律关系。业主行使抗辩权的依据除法律规定外还来源于物业服务合同约定。物业服务合同是一种新型的有名双务合同,利用现有的合同法中的一般原则无法妥善处理物业服务合同纠纷,为响应实际需要,应当由法律另行规定。业主委员会与业主个体均应当是物业服务合同法律关系中的正当主体,但两者的抗辩权基础有所差异。第三章进一步论述了业主在物业服务合同履行中如何正当行使抗辩权,并结合第一章物业服务合同纠纷中就业主抗辩理由司法认定有争议的几个事由进行了分析和认定。业主抗辩权的行使不能是无限度的,为防止业主滥用抗辩权,应当增加业主行使抗辩权的法律成本,建议建立相应的法律惩罚机制。最后对于物业服务合同纠纷的妥善解决提出了几点完善建议。结语部分是对全文的进一步总结。

【Abstract】 In recent years,the property service contract dispute has become one of the main cases of civil disputes,and the number of cases has the trend of increasing year by year.Although the subject matter of the property service contract dispute is small lawsuit,it is usually a"mass" case,if not properly handled,it can easily lead to fierce social contradictions,and it is not conducive to the construction of a socialist harmonious society.The Property Services Contracts are usually manifested in the form of property services companies that sue owners to pay their arrears of property services,while the owner is exercising the right of defense against property services.Therefore,the study of property service contracts in the implementation of the right to correct the right of the owners of the right to defend the property service contract disputes can be effectively.The introduction part of the research briefly described the background and significance,and explains the necessity and method of studying the exercise of the owner’s right of defense.The first chapter uses the method of empirical analysis to study the status quo of the owner’s right of defense in the process of fulfilling property service contract in China.Combined with the case data summarizes the characteristics of the owner’s defenses,the main cause of the owner’s defense in the service contract,and the judicial determination in the trial.By enumerating the form of typical cases,it is found that in the judicial decision,the case of property service contract dispute cases is more serious,it is thought to be introduced,and the reasons of the dispute of property service contract dispute are summarized and the phenomenon is chaotic.The second chapter analyzes the legal relationship of property service contract,The basis for the exercise of the right of defense by the owner is also derived from the property service contract.The Property service contract is a new type of well-known dual-service contract,the use of existing contract law in the general principles can not properly handle the property service contract disputes,in response to actual needs,shall be otherwise provided by law.The owners’ committee and individual owner should be the proper subject in the legal relationship of property service contract,but the basis of the defenses.The third chapter further discusses how the owners in the performance of the service contract in the right to exercise the right of defense,and combined with the first chapter of the property service contract disputes in the owners of the reasons for the defense of the judicial identification of several issues were analyzed and identified.Owners of the right of defense can not be exercised indiscriminately,in order to prevent owners from abuse of the right of defense,It is necessary to increase the legal costs of the owner to exercise the right of defense,it is proposed to establish the corresponding legal punishment mechanism.Finally,some suggestions are put forward for the proper settlement of property service contract disputes.Epilogue part is the further summary of full paper.
