【摘要】 近十年来,随着互联网技术的日新月异和电子商务的蓬勃发展,网购与快递已成为人们日常生活中极为常见的交易活动,其方便、及时、快捷深受广大消费者的青睐,但由于行业发展迅猛而行业监管跟不上,我国快递行业凸显了诸多问题。制度层面,我国邮政体制改革后,国家邮政局成为快递行业行政主管部门,但相关法律法规不健全、规定不甚合理。现实层面,我国本土大中小型民营快递企业迅速壮大和扩张,存在着加盟门槛极低、经营灵活但管理较混乱等问题。许多快递公司存在收寄验视制度执行不到位、安全管理措施难到位、快件损毁丢失、管理人才欠缺等问题。当前我国快递行业监管以邮政管理部门监管为主,辅之以公安部门治安管理、工商等部门职责内监管。主要法律规制为《中华人民共和国邮政法》《快递市场管理办法》《邮政行业安全监督管理办法》等,主要监管手段为许可准入、安全检查等。本文从我国快递行业监管现状出发,分析当前快递行业监管存在的问题,将其归纳为行业监管法律法规混乱、市场准入许可设置不合理、行业监管手段单一监管效能低下、行业安全生产隐患和治安隐患突出、行业自治组织薄弱无力等问题,由此出发,我们提出了提高立法的透明度和公众参与度、降低快递行业市场准入门槛并促进市场竞争、丰富监管手段创新监管方式提高监管效能、公安部门加强快递行业治安管控、充分发挥快递协会行业自律作用等5个方面的对策建议,旨在完善快递行业监管,促进行业发展。更多还原

【Abstract】 A situation of tripartite confrontation in last 10 years,with the great development of the Internet and the rise of e-commerce,online shopping and express has become the people living in extremely unusual trading activity,it is convenient,fast and timely,favored by the vast number of consumers.But because of the rapid development of the industry and industry regulators can not keep up,China’s express industry highlights many problems.The system level,China’s postal system reform,the State Post Bureau became the administrative department in charge of the courier industry,but the relevant laws and regulations are not perfect,the provisions are not reasonable.The soil of small and medium-sized private express enterprises grow rapidly and there is a franchise expansion,the threshold is very low,but more flexible business management confusion and other issues.There are many express acceptance visual inspection system implementation is not in place,the safety management measures in place to express,damage and loss,lack of less management talents.The current China’s express industry supervision to postal administration supervision based,supplemented by the public security departments in the administration of public security,industry and commerce departments in the supervision duties.The main legal regulations for "People’s Republic of China postal law" "express market management approach if the postal industry safety supervision and management measures >,main means of supervision for permission,safety inspection from the.The status quo of China’s express industry supervision,analyzes the existing problems in the supervision of the courier industry,which can be summarized as the industry regulatory laws and regulations permit access to market confusion,unreasonable industry regulation means a single regulatory efficiency is low,industry production safety risks and security risks outstanding,forThe problem,industry autonomy organization is weak etc.based on this,we put forward to improve the transparency and public participation,reduce the express market access threshold and promote market competition,enrich the means of supervision to improve regulatory efficiency,multi sectoral work together to ensure the safety industry,give full play to the role of industry associations to express such proposals in 5 aspects.更多还原
