【摘要】 司法公正的判断实际上是司法活动参与者对司法过程和裁判结果是否公正的主观认知。主体所处的客观环境和对利益诉求的不同,使其对于司法公正的认知具有复杂性和多元化的特点。而我国社会学界对于司法公正的分析一直处于理性、客观的阶段,而对主观性、过程性方面的论述有所不足。这样对司法公正的本质就难以进行全面的把握和认识。马克思主义公平正义观内在地蕴涵着实质公正的价值取向,是社会主义社会应遵循的科学的公平正义观,它认为公平正义要达到客观性与主观性的统一时才是人们一直所追求的公平正义。马克思主义公平正义观还认为不仅要求分配公平,初次分配也要求公平,不仅要求形式公平,更要求实质公平,因此追求法律效果与社会效果的同步实现是社会主义司法公正的基本任务。以这两个要求为基准,去探寻社会主义司法公正的实现途径,才能保证社会主义司法公正得以真正的实现。第一部分,首先通过系统的梳理马克思主义公平正义观形成的理论来源和形成阶段的重要思想,阐明马克思主义公平正义观的主要内容:他们认为社会公正的根本状况取决于社会的生产方式和生产资料所有制,公平正义在每个时代都有特定的内容,因此公平正义要达到客观性与主观性的统一并且达到其社会目的时才是人们一直所追求的公平正义。第二部分,首先对西方在公平正义理论的探索做一梳理,再通过马克思主义公平正义观对资本主义公平正义观的超越,揭示出马克思主义公平正义观是社会主义社会应遵循的科学的公平正义观,是社会主义司法公正的理论基础,它也揭示了社会主义司法公正的实质,对实现社会主义司法公正有着重要意义。第三部分,通过结合马克思主义公平正义观,从司法活动的各个参与者对司法过程和结果是否公正的主观认知的归纳以及对司法公正主观认知的困境深入探讨,力图从司法公正的客观性和主观性两个方面去把握社会主义司法公正的本质。第四部分,以马克思主义公平正义观为指导从实现法律效果和社会效果统一和实现司法公正的主观性和客观性的统一为基本要求,结合我国司法公正的实际情况,从立法活动、司法活动、审判活动出发,探寻实现社会主义司法公正的路径。更多还原

【Abstract】 The judgment of judicial justice is actually the subjective cognition of the judicial process and whether the judicial result is fair or not.The objective environment and interests of the subject are different,so that the cognition of judicial justice is complex and diversified.However,the analysis of judicial justice has been in a rational and objective stage in our social circles,but there are some deficiencies in the subjective and procedural aspects.In this way,it is difficult to grasp and understand the essence of judicial justice.Marx’s view of justice embodies the value orientation of substantive justice,fairness and justice is the socialist society should follow the scientific concept,it considers fairness and justice to achieve the objectivity and subjectivity is fairness and justice has been pursued,Marx’s view of justice also believes that not only requires a fair distribution in primary distribution justice,not only the form of equity requires synchronization of substantive fairness,thus the pursuit of legal effect and social effect of justice is the basic task of socialism.On the basis of these two requirements,to explore ways to realize socialist judicial justice,we can guarantee the realization of socialist judicial justice.The first part firstly systematically Marx’s view of justice theory and the important thought of the source of the formation of formation stage,clarify the main content of Marx’s view of justice,fairness and justice to achieve the objectivity and subjectivity is the pursuit of fairness and justice has been.The second part,first of all to do a comb in the exploration of western justice theory,and through Marx’s view of justice of fairness and justice beyond capitalism,reveals Marx’s view of justice is fairness and justice of the socialist society should follow the scientific concept of socialist justice theory based on the realization of justice is important the significance of socialist justice,it also reveals the essence of socialist justice.The third part,through the various participants of the judicial activities of the judicial process and the results are summarized and the subjective cognition of justice of judicial justice subjective cognitive dilemma in-depth study,combined with Marx’s view of justice,tries to grasp the essence of socialist justice from the objectivity of judicial justice and subjective two aspects.The fourth part,by Marx’s view of justice as a guide from the unity of legal effect and social effect and the unity of the realization of justice of subjectivity and objectivity as the basic requirements,combined with the actual situation of judicial justice in our country,from the legislative,judicial activities,trial activities,explore the path to achieve socialist justice.更多还原
