企业工作时间立法的利益平衡问题研究

【摘要】 富士康“跳楼门”、快递小哥在工作岗位猝死等悲剧事件频频见诸报端,折射出我国劳动者保护机制的缺失——从对劳动者工作时间、工作强度的保障,到对劳动者身体和心理健康危机的防范,再到“过劳死”认定和补偿机制的整体落实,都有太多的不足。生活中,长时间的超负荷劳动工作使得很多劳动者的身体长期处于亚健康状态。这种情况下,我们不禁反思:这些劳动者们何以实现对个人尊严的支撑、对安定生活的保障,以及对和谐社会向往?从中央到地方,劳动监察部门不断推进执法、加大了执法力度,旨在遏制违法加班,促进用工环境的和谐;当前各级政府也在致力于运用激励和约束手段,不断健全有关劳动立法和工作时间相关制度;全社会共同参与、覆盖城乡居民的社会保障体系正逐步趋于完备,这无疑令人欣慰。但是,各类企业中违法加班的情况依旧存在并愈演愈烈,要彻底破解这个难题,并没有立法者预期的那般简单。根本而言,是由于企业工作时间的相关立法及制度未能有效地实现各主体的利益均衡。对此,除去引言和结论,本文第二章至第七章从不同角度对企业工作时间立法中的利益平衡问题进行研究:结合当前普遍存在的超时加班现象和有关企业工作时间的立法现状,研究国外典型的国家和我国工作时间立法的历史演进与制度分类,总结有益经验;然后分析我国当前工作时间相关立法的不足,即多方原因导致各主体之间难以实现利益平衡;最后有针对性地提出完善我国工作时间立法、实现其中利益平衡的法律思考,此为本文重点部分。本文以实现利益平衡为主线,由比较法之视角,审视我国工作时间立法的现状,就相关制度之间的衔接和协调,借“他山之石”以探索当前市场机制下实现工作时间立法利益平衡的可行出路。
【Abstract】 So far,the process of market-oriented reform has made Chinese economy change a lot.However,while China’s economy is growing,economic disparity between regions is enlarged.Different regions have implemented local policies,which do damage to market integration and economic cooperation between regions.Therefore,the state puts forward the integrated regional development.Mid-China’s Rising was directed by this guide line.And it is becoming the state’s strategy.Foxcon “Jumping events”,courier sudden death on the jobs report published in newspapers frequently,reflects the lack of worker protection mechanism in our country---from Protection of laborers working hours,working strength,Physical and mental health of laborers of crisis prevention,To "karoshi" acknowledgment and compensation mechanism of the overall implementation,there are too many shortcomings.In the life,long time of overload Work has led many workers body sub-health state for a long time.In this case,we can not help but reflect:how these workers Realize the support of personal dignity,for the guarantee of a stable life,and dreams of a harmonious society?From central to local levels,the labor inspection department to push the law enforcement,strengthen the law enforcement,Aimed at curbing illegal work overtime,to promote employment environment of harmony,The current government entities at all levels are committed to using the means of incentive and constraint,constantly perfect the related system of labor legislation and working hours.To participate in the whole society,the social security system covering urban and rural residents is gradually tend to be complete,it certainly encouraging.However,in the enterprise of illegal overtime still exist and intensified,thoroughly crack this problem,and not simple.Essentially,it is because the enterprise working time of the relevant legislation and system failed to effectively realize the main body of benefit equilibrium.To this,remove the introduction and conclusion,this paper,the second chapter to the seventh chapter from different angles to the enterprise work time to study the problem of balancing of interests in legislation:Combined with the current widespread phenomenon of excessive overtime working hours legislation present situation and relevant enterprises,study the typical countries and our working hours legislation system of historical evolution and classification,summarizes several experiences;Then analysis the deficiency of the current working time legislation in China,the various causes is difficult to realize benefit balance between different subjects;Finally puts forward to perfect our legislation work time,the realization of the interests balance law thinking,this is the key part of this article.In this paper,in order to realize the balancing of interests as the main line,from the perspective of comparative law,review our working hours legislation present situation,the cohesion and coordination between the relevant systems,The stones of those hills may be used to polish gems.The good experience of other countries for reference to explore the current implementation work time legislation under the market mechanism of balancing of interests feasible way.
