【摘要】 随着经济与社会的发展,政府对公共产品和服务的供给愈发难以满足日益增长的社会需求。政府积极引入PPP模式,充分利用社会资本的先进技术和管理经验来缓解供给压力,同时提高公共产品和服务的供给效率。PPP模式中的政企合作关系需要双方高度的法治精神和契约精神,尚未健全的PPP法治体系尚不能满足投资体量大、项目时间长的PPP项目所需的法治环境,作为合作方的政府欠缺与非政府主体合作所需的协作、互利的契约精神。PPP项目涉及到的基础设施本身的公共性和社会性也决定了作为提供公共产品或服务的PPP直接关系到社会公共利益。因此,加强对PPP的监管,构建一种高效、可行的监管模式十分必要。PPP模式的精髓在于合作,政府方与社会资本方利用各自优势,基于以最少的资源实现最多的产品或服务这一合意进行合作,针对PPP的监管也需要找到一种以最少资源获取最好监管效果的模式。由此,本文提出一种以激励为核心的PPP监管模式。本文首先对现有PPP监管进行了探讨。对我国PPP监管现状进行了研究,系统梳理了我国现有的PPP相关监管规范,指出我国现有PPP监管的体制缺陷以及激励性的欠缺。具体表现为:监管立法滞后,政府监管理念、监管体制和监管方式不健全,政府内部监管不完善,欠缺公众参与与配合。文章第二部分借鉴法律激励功能理论以及委托代理激励理论,对PPP激励监管模式进行了理论证成,并提出了PPP激励监管模式的概念及内涵。通过立法为先导,构建政府、社会资本与公众共同参与的监管模式,满足政府以及社会资本的期望效用,以实现社会福利的最大化。文章第三部分从必要性和可行性两方面对PPP激励监管模式进行了现实证成。通过PPP自身特点和PPP监管特点说明了 PPP激励监管模式是必要的。通过考察域外先进国家的激励监管措施和分析我国PPP监管状况等内外条件,说明PPP激励监管模式是切实可行的。文章最后一部分是对PPP激励监管模式的具体构想。通过PPP激励监管模式的目的、原则、考量因素和具体措施等四个层面对PPP激励监管模式进行了分别阐释,并提出了具体的政策建议。更多还原

【Abstract】 With the development of economy and society,public products and services supplied by the government is increasingly difficult to meet the growing social needs. Therefore,the government actively introduces the PPP model, and makes full use of the advanced technology as well as management experience of social capital to alleviate the supply pressure,then improves the supply efficiency of public products and services.The enterprise cooperation need both sides height in the PPP model of rule of law spirit and the spirit of contract, not a sound PPP equivalent system of rule of law is still can not adapt to investment,long project time needed for the PPP project of rule of law environment, The government, as a partner, lacks the spirit of equality, freedom, cooperation and mutual benefit required for non －governmental cooperation. The publicity and sociality of the infrastructure involved in the PPP project also determines that PPP, as a provider of public products or services, is directly related to the social public interest. Therefore, it is necessary to strengthen the supervision of PPP and to build an efficient and feasible regulatory model.The essence of the PPP model is cooperation, that is to say, the two sides use their own advantages to achieve the most products or services based on the least resources in order to cooperate in this consent. For the supervision of PPP, it also needs to find a model with minimum resources to obtain the best regulatory effect. Thus, this paper presents the PPP regulatory model with incentive as its core.This paper firstly discusses the existing PPP regulation model and systematically studies the existing regulations of PPP in China, as well as teases the existing regulation system. It also points out the institutional defects and the lack of incentive of the existing PPP regulation model, which is showed as regulatory and legislation lag, the concept of government regulation, undeveloped regulatory system and regulatory approach, lack of internal government regulation, lack of public participation and cooperation.The second part of the article takes examples from the theory of the legal incentive function and the incentive theory of principal and agent,and makes a theoretical proof of PPP incentive regulation model, then puts forward the concept and connotation of PPP incentive regulation model. Through legislation as the guide,the regulatory model will be built which government,social capital and the public all participate in to meet the government and the expected utility of social capital in order to achieve maximum social welfare.The third part of the article from the necessity and feasibility aspects of PPP incentive regulatory model in the reality. It is necessary to explain the PPP incentive regulatory model through the characteristics of PPP itself and its regulatory characteristics. By investigating the incentive measures of advanced countries in the region and analyzing the internal and external conditions of PPP supervision in China, it shows that the PPP incentive model is feasible.The last part of the article is a concrete idea of the PPP incentive regulatory model. This paper explains the PPP incentive model through the four aspects of the purpose, principle,consideration and concrete measures,and put forward the concrete policy suggestions.更多还原
