打击错误的处理原则研究

【摘要】 在司法实践中打击错误的案例时有发生,在理论上也存在法定符合说和具体符合说的争议。以张明楷为代表的学者主张法定符合说,而且在司法实践中也偏重于法定符合说。但是通过对具体案例分析可以认为,在打击错误的案例中运用具体符合说来定罪量刑更为合理。从反对动机来看,行为人在实行危害行为时有形成反对动机的机会,而行为人在形成反对动机时是针对具体的对象的,从而说明行为人在犯罪时应当是针对的具体的对象。从犯罪构成来看,法官认定行为人的故意心态是需要证实其实施犯罪行为时的认识因素和意志因素,按照法定符合说来认定罪犯的故意心态就缺少了意志因素,就难以认定其是故意犯罪的,而具体符合说更符合责任主义以及我国现行的宽严相济的刑事政策。法定符合说质疑具体符合说在处理打击错误时存在难以区分对象错误和打击错误、对象错误不阻碍故意而打击错误阻碍故意、会导致罪刑不相适当、对于财产型犯罪处理不当等弊端,这是种误解;实际上法定符合说处理打击错误时存在缺陷,例如:有故意的拟制容易导致故意犯范围的扩大、忽视因果关系的偏离、结果加重犯的不当增多、对社会的一般观念的忽视,在阻却故意的情形下陷入二难困境等等。因此,在打击错误的情形下更应提倡运用具体符合说进行处理。更多还原

【Abstract】 The cases of combat error often come upinthejudicial practice.In theory,there is dispute between theory of statutory conformation and theory of concrete conformation.Represented by ZhangMing Kaischolars advocate the theory of statutory conformation,in the judicialpractice,these judicial staffs lay particularstress on the theory of statutory conformation.But below that thecases of combat errorusetheory of concrete conformation to speaking more reasonable for conviction and sentencing.First,the article start with the reactionary motivation,the criminal in the hazard behavior have formed against the motivation.In formation against the motives criminals is targeted at specific objects,to illustrate the criminals should be targeting a specific object of the crime.Then from the constitution of crime to argue,the judge ruled that behavior person deliberately mentality includes cognition factor and will factor.In accordance with the theory of statutory conformation to say that criminal’sintentional mentality factors lack the will,and It will be difficult to determined the intentional crime.The theory of concrete conformation more conform to theprinciple of criminal liability and criminal policy of combining punishment with leniency.Secondly,the theory of statutory conformation has some questions forthe theory of concrete conformation.These responses are stated in the following article one by one.Thirdly the unreasonable aspects also are proposed in the article if we use the theory of statutory conformation to deal with combat error.更多还原
