【摘要】 在犯罪行为逐步科技化,侦破案件难度增加的情况下,技术侦查应运而生,但是由于技术侦查不同于传统侦查方式,其技术性、隐蔽性和易侵权性的特点使得其在一定程度上会侵害到公民的隐私权。虽然新《刑事诉讼法》对技术侦查进行了相应的规制,但是由于立法的原则化,对其程序规制仍然很笼统,容易侵犯侦查相对人的隐私权。本文具体分析技术侦查中隐私权保护存在的问题,从技术侦查适用范围、适用条件,技术侦查的监督机制,获取证据保存使用以及对隐私权法律保护等方面展开讨论,为我国技术侦查侦查中隐私权的保护带来有益构想。为更深入的研究技术侦查中隐私权的保护问题,本文通过对美国监听制度,德国监听制度,英国的技术侦查制度中隐私权保护措施的分析与比较,对域外技术侦查中隐私权保护的相关特点以及先进经验进行探讨。本文最后针对我国技术侦查的适用规范、审批程序、证据规定、隐私权立法保护以及权利保障等方面存在的问题提出了完善建议,以期技术侦查制度走向规范化、法治化。更多还原

【Abstract】 In order to deal with the crime of organization of the modernization of technical investigation came into widespread use,but due to technical and technical investigation of concealment,easy infringement,the technical investigation is widely used in a certain extent to infringe the privacy of citizens.Although the new "criminal procedural law" has made a series of specific provisions of technical investigation,but because of the principle of legislation,the technical investigation of the program control is too simple,easy to infringe the citizen right of privacy.This paper makes a concrete analysis of the technical investigation of privacy protection issues,from the technical investigation scope,applicable conditions,supervision mechanism of technical investigation,evidence preservation and access to legal protection of privacy and other discussions,bring beneficial ideas for the protection of China’s technical investigation of the right of privacy.In order to further study the issues of the privacy protection in criminal proceedings,the paper further discusses the inspirations from relevant features of the privacy protection system in foreign criminal investigation and advanced foreign experience through the inspection and comparison of American monitor systems,German monitor systems,the England monitor system.In order to protect the human rights,According to our technical investigation of the applicable code,approval procedures,rules of evidence,privacy protection and rights protection legislation and other aspects of the problem put forward the suggestions for improvement,Looking forward to the technica investigation system becomes standardization and legalization.更多还原
