【摘要】 大数据信息时代的到来,对于我们的生活带来不一样的影响。本文以大数据影响我们个人信息安全的角度来做一分析。个人信息的安全与否不仅关系到个体的人格权益,涉及到隐私权、名誉权、荣誉权等相关民事权利。如果个人信息安全遭到严重的危险甚至侵犯,这就牵涉到了一定的刑事责任,若情况更为严重,就有可能影响社会公共利益和国家安全利益。本文首先对大数据与个人信息安全进行描述,描述了大数据的概念与涵义、运作模式以及运作过程中的特点;其次描述了在个人参与大数据运作过程中相关法律关系里的主客体与大数据运作对于个人信息安全所带来的影响;详细剖析了大数据时代个人信息权益遭受侵犯的犯罪方式以及犯罪特征;对比欧、美、日、德等国家、地区有关个人信息安全的立法情况,根据我国现行法律对于个人信息安全的重视程度,提出了加强针对大数据运作中个人信息安全保护的立法、完善《侵权责任法》、引导重点行业推出自律规范和公约、推行个人信息安全保护的管理标准、健全个人信息安全保护的组织机构一系列意见,希望能够对于我国公民个人的信息安全保护有所帮助。更多还原

【Abstract】 The advent of the era of big data information, different effects for our life. Based on large data for our personal information to do the analysis. Personal information security or not is not only related to the personality rights and interests of individuals, involving privacy, right to reputation or honor and related civil rights. If personal information security risk of serious violations, even it’s involved a certain criminal liability, if the situation is more serious, it is possible to affect the social and public interests and national security interests. This article first capture large data and personal information security, to understand the concept and meaning of big data, operation mode and characteristics in the process of operation; Secondly described in the process of individual persons to participate in big data operation related the subject and object in the legal relationship and big data operation for personal influence brought by information security; Detailed analysis of personal information rights are infringed by the era of big data method and characteristics; Than in Europe, America, Japan, Germany and other countries and regions on the personal information security legislation, according to China’s current law on personal information security degree, put forward to strengthen in view of the large data operation in the personal information security protection legislation, perfecting the tort liability act, guide the key industry self-discipline norms and conventions, personal information safety protection management standards and improve the personal information security protection organizations a series of opinions, hope can also help our country citizen’s personal information security.更多还原
