【摘要】 空间资产融资(包括融资租赁、所有权保留买卖以及抵押担保)是一项新兴的商业行为,由于空间资产这类大型移动设备有着移动速度块、移动范围广等特点,且其位置大部分时候并不位于地球表面,故其无法简单地依照国际私法上“物之所在地”的原则来确定管辖权,再加之各国对融资行为的规定各不相同,因此,融资关系中债权人的权利往往无法在全球的范围内得到有效保障。为了解决此困境,在国际统一私法协会的主导之下,缔约国通过《移动设备国际利益公约》及其《空间资产特别问题议定书》的形式创设了空间资产国际利益登记制度,此制度从其本质上来说是一种依约定产生的非占有性物权的公示制度,其不仅表明了空间资产上利益的持有状况,还为已登记的利益对抗后登记的利益或未登记的利益提供了合法依据。除了引言和结语,本文一共分为四章:第一章主要讨论空间资产国际利益登记制度的基础,包括法律基础、基础性概念以及空间资产国际利益登记制度与空间物体登记制度的区别;第二章主要讨论空间资产国际利益登记制度的体系,包括登记的主体、登记的客体以及登记的事项;第三章主要讨论空间资产国际利益登记制度的功能,包括登记的一般作用,登记的辅助作用以及登记的时效;第四章主要讨论空间资产国际利益登记制度对中国的启示,包括中国相关法律制度,中国航天产品贸易以及中国的应对举措;更多还原

【Abstract】 The space assets financing(including financing lease,title retention,and collateral)is an emerging commercial behavior.The space assets like these kinds of large mobile devices have high speed,wide moving rang and other characteristics,otherwise,its location is not on the earth’s surface in most of the time,so it cannot simply in accordance with the "content of the site" principle of the international private law to determine jurisdiction,and the regulations on about financing are different from each other among different countries,therefore,creditors rights in the financing relationships often cannot effectively be protected on a global scale.In order to solve this dilemma,under the leading of uniform international law association,states parties created the interests of the international interests registration system of space assets by the forms of the convention on international interests in mobile equipment and the protocol on the special issue about space assets.In essence,this system is a kind of publicity system of non-possessive property in accordance with the contract,which not only shows the holding situations about the interests on space assets,also provide lawful basis for the interests registered to prior to the interests registered afterward or the interests unregistered.In addition to the preface and epilogue,this article is divided into three chapters in all:The first chapter mainly discusses the basis of the international interest registration system on space assets,including the legal basis,the basic concept and the difference between the international interest registration system on space assets and the registration system of space objects;The second chapter mainly discusses the system of international interest registration system on space assets,including the main body of registration,the object of registration and the matter of registration;The third Chapter mainly discusses the functions of the international interest registration system on space assets,including the general role of registration,the auxiliary role of registration and the aging of registration;The fourth chapter mainly discusses the revelation of the international interest registration system on space assets,including the relevant Chinese legal system,the trade of China’s space products and the response of China.更多还原
