【摘要】 法官职业保障制度是当前我国司法改革中需要完善的众多司法制度中的一项重要内容,其重要性不言而喻。法官职业保障制度的完善不但是对法官职业群体职业付出的回报和尊重,更是维护社会法治公平正义的重要组成部分。本文主要采用实证分析、比较研究等法律方法,将理论和实践充分结合来分析法官职业保障制度的内涵、意义及全面观察比较中外法官职业保障制度的现状,最后提出对我国法官职业保障的建构意见。全文共分为四部分。第一部分是介绍法官职业保障制度的内涵及其意义。名不正则言不顺,因此笔者在第一部分将着重阐释法官职业保障制度包括的基本内容,站在整个司法制度构建的全局来观察分析法官职业保障制度对于司法公正运行、法官队伍建设、司法文明发展的重要意义。第二部分是对我国法官职业保障制度的问题考察。通过最新和尽量全面的基础性的数据来真实反映出当前我国法官职业保障制度的特点及全貌,以及我们对法官职业保障制度构建思路和认识上的一些经验和误区,在制度建立上的一些问题和亟需完善的方面,着重分析我国法官职业保障制度在发展过程中的问题。第三部分是对国外法官职业保障制度考察及启示。介绍国外法官职业保障制度的概况。相比于以往对国外法官职业保障制度介绍中单纯的介绍西方发达国家职业保障制度不同,笔者也力求更多引入其他发展中国家,如巴西、印度、俄罗斯等国家在法治建设进程中法官职业保障制度的概况,从而为构建立足于我国国情、我国社会发展阶段的法官职业保障制度发展提供参考借鉴。第四部分是对于我国法官职业保障制度健全完善的原则及设计思考。首先,确立完善法官职业保障制度的原则,把握住完善我国法官职业保障制度的正确前进路径。在此基础上,结合前面三部分内容对于我国法官职业保障中权力保障、经济保障等全方位的法官职业保障制度建构提出笔者的想法。更多还原

【Abstract】 The judge’s professional security system is an important part of the judicial system which needs to be perfected in the judicial reform of our country.The perfection of the judge’s professional security system is not only an important part of the social justice of the rule of law,but also an important part of the social justice.This paper mainly uses empirical analysis,comparative study of law method,the combining theory and practice to analyze the current situation and comprehensive observation of the connotation,the judge occupation guarantee system significance comparing the judge’s professional security system,and finally put forward opinions on the construction of our country judge occupation protection.The full text is divided into four parts.The first part introduces the connotation and significance of the judge’s professional security system.A regular speech is not suitable,so the basic content of the first part will mainly explain the judge’s professional security system including the overall construction,stand in the entire judicial system to observe and analyze the judge’s professional security system is important to the operation of justice,the judge team building,the development of judicial civilization.The second part is the empirical research and analysis of the problems of the judge’s professional security system.Based on the new and comprehensive data to try to reflect China’s current judge’s professional security and the characteristics of the picture,and we judge occupation guarantee system construction experience and misunderstanding of ideas and understanding of the system on some problems and need to improve aspects,focuses on the analysis of problems in the development process the judge in the occupation guarantee system in our country.The third part is the investigation of foreign judges’ professional security system.Introduction of foreign judges’ professional security system.Compared to the previous foreign judge’s professional security system introduced in a simple introduction to different occupation guarantee system in western developed countries,the author also tries to introduce more other developing countries,such as Brazil,India,in Russia and other countries in the construction of rule of law in the process of the judge’s professional security system,so as to provide a reference for the establishment of our country and our society the development stage of the development of the judge’s professional security system for construction.The fourth part is about the principle and design of our country’s professional security system.First of all,we should establish the principle of perfecting the professional security system of judges,and grasp the correct way to improve our professional security system.On this basis,the author puts forward the author’s ideas on the construction of the judge’s professional security system in China,such as the protection of the power of the judge,the economic security and so on,with the former three parts.更多还原
