【摘要】 为了贯彻宽严相济的刑事政策与非监禁刑罚的不断发展,社区矫正成为目前刑罚执行的重要方式。作为可以控制社区矫正对象人身危险性,降低再犯风险的社区矫正对象人身危险性评估制度(以下简称"社矫对象评估制度"),在我国社区矫正的执行中有着重要的地位。它是社区矫正制定科学的矫正方案,提高矫正的质量和效果的必要依据。在国外很多国家,这项制度已经发展成熟,有着统一的立法和完备的程序。反观我国,目前还没有制定统一的社矫对象评估制度,一些地方为了矫正工作的科学性,率先开展评估的实践活动。由于没有统一的立法,在操作过程中存在着许多争议问题,如评估主体不统一,实施程序不统一,评估工具不统一的情况。因此,对我国社矫对象评估工作进行法律化、制度化建设极为紧迫。本文通过介绍社区矫正试点地区的评估实践工作,结合国外的优秀经验,深入分析了社矫对象评估制度的立法和程序问题。并从立法上和程序上构建我国社矫对象评估制度,并赋予社矫对象在评估制度中基本的权利。以此解决实践中的争议问题,增强社矫评估制度的可操作性和实际效果。更多还原

【Abstract】 Community correction has become an important way to implement the current penalties in order to keep the continuous development of non-custodial penalties and carry out the criminal policy of combining leniency and harshness.The assessment mechanism of the personal dangerousness about the community correction object(hereafter called " the assessment mechanism of community correction object")play a vital role in the implementation of community correction in our country,which can control the physical risk of community correction and reduce the risk of recidivism.It is essential basis for community correction to develop scientific correction programs and improve the quality and effectiveness of the community corrections.The system has been well developed with the unified legislation and complete procedures in many foreign countries.Meanwhile,China has not developed an unified assessment mechanism of community correction object,some places started practical activities of the assessment in order to correct the scientific work.Since there is no unified legislation,there are many controversial issues in practice,such as non-unifying subjects,non-unifying implement program and non-unifying evaluation criteria.Therefore,it is urgent for China to legal and institutionalize the assessment mechanism of community correction objects.The paper analyses the legislative and procedural issues about the assessment mechanism of community correction object through the introduction of the practice of some regions where carry out the assessment mechanism,which combined with the foreign outstanding experience.The paper build the legal system of the assessment mechanism of community correction objects legislatively and procedurally,and empower the community correction objects in the assessment mechanism at the same time.With the problem solving of the dispute in practice,to enhance the operability and practical effect of the assessment mechanism by this paper.更多还原
