民间借贷实务分析

【摘要】 民间借贷是一种融资活动,它把筹集资金作为目的,它的主体是自然人、法人及其他组织。我国近几年市场经济迅猛发展,大量中小企业如雨后春笋般产生、发展并壮大,其对资金的需求量也不断增多,而此时的民间资本越来越富裕,中小型企业为融资但考虑到正规金融审批手续严格、繁琐,多从民间筹集资本,这成就了民间借贷的发展。民间借贷发展迅速,有关民间借贷的法律却相对滞后,因此引发了一系列的问题。为此,本文以某县为例,结合相关审判实务对某县的民间借贷案件基本情况,民间借贷存在的审判难点问题进行剖析,并以此提出完善民间借贷的建议。本文共分三个部分,第一,关于某县人民法院审理民间借贷案件情况。通过分析案件基本情况,概括出该县民间借贷纠纷案件存在的一些特点;第二,关于民间借贷纠纷的审判难点。表现为民间借贷纠纷的案由与定性问题,以名为买卖实为借贷典型案例进行分析,借贷行为的效力认定问题,举证责任分配以及借贷利率问题。笔者结合《民间借贷规定》对审判中存在的问题,给予了进一步分析;第三,从完善民间借贷的法律体系、监管机制、信用机制等方面提出完善民间借贷的建议。更多还原

【Abstract】 Private lending is a kind of financing activities,it to raise funds as the purpose,it is the body of the natural persons,legal persons and other organizations.Our country market economy fast developing in recent years,a large number of small and medium-sized enterprises have sprung up to produce,develop and grow,the demand for money is also constantly increased,while the private capital is more and more rich,for small and medium-sized enterprise financing but considering the formal financial examination and approval procedures strictly,tedious,from folk to raise more capital,the achievements in the development of private lending.Private lending has developed rapidly,the folk lending and the legal lag,thus led to a series of problems.In some county in,for example,this paper,combined with related judicial practice in cases of private lending in the basic case,the trial difficult problems of private lending,and proposes Suggestions to perfect the folk lending.This article is divided into three parts,the first,about some county in the people’s court folk loan case.By analyzing the case of basic situation,summarizes the county folk lending the disputes exist some characteristics;Second,about the folk lending dispute trial difficult.Characterized by informal lending causes disputes with qualitative problem,known as lending to business is a typical case analysis,the effectiveness of the borrowing that problem,the burden of proof allocation and lending rates.The author of folk lending rules on the problems existing in the trial,gives further analysis;Third,from the perfect legal system,supervision mechanism of private lending,credit mechanism and so on perfect folk lending advice is put forward.更多还原
