【摘要】 居住是人类安身立命之根本,只有安居,才能乐业。居住也是为人类繁衍生息及自身发展服务的,人类不同的生产和生活方式同时也决定和改变着居住的方式和方法。党的十八届三中全会通过的《中共中央关于全面深化改革若干重大问题的决定》明确指出:“保障农村居民宅基地用益物权,改革完善农村宅基地制度,选择若干试点,慎重稳妥推进农民住房财产权抵押、担保、转让,探索农民增加财产性收入渠道。”2015年中央一号文件也要求“改革农民住宅用地取得方式,探索农民住房保障的新机制。”在政策的层面上,农村房屋市场化是改革的必然趋势,也是现实的迫切需求。在此基础上,本文探讨农村房屋买卖的法律问题,提出解决问题的思路,无论对理论还是对实务都会有所帮助。本文除了引言和结语外,主要结构为三个大的部分。第一部分从农村房屋买卖的现有情况入手,重点交待了农村房屋买卖纠纷的情况,以及透过两个案例分析了人民法院对这类纠纷的处理思路,引出了现有政策对该问题的态度和理论界对农村房屋买卖合同效力认定的争议。第二部分是分析现有政策存在的不足,提出了若干现有农村房屋买卖存在的问题,分别从理论和实践角度分析了相关理论的缺失和司法实践中存在的困境,为探讨解决问题寻找思路。第三部分提出了一些问题解决的措施和相关政策的完善建议,特别是在新的时期,城镇化发展的大背景下,如何平衡保障农村居民基本的居住权和完善农村房屋宅基地流转二者之间的关系,以及司法机关对愈发突出的社会矛盾的处理建议,特别是人民法院在审理农村房屋买卖案件时在法律范围内如何实现社会公平正义与公序良俗提出了参考。本文作者认为,我国在全面建设小康社会的新阶段,妥善处理好农村业已存在的问题,发展好完善好相对应的政策法规,有利于提高人民收入水平,维护社会和谐稳定的局面,开创社会主义建设的新阶段。更多还原

"2015 central document also requires "residential land reform farmers made way to explore new mechanisms to protect the farmers’ houses."At the level of policy, the rural housing market-oriented reform is an inevitable trend, but also the reality of the urgent needs. On this basis, this paper discusses the legal sale of rural houses, put forward ideas to solve the problem, regardless of theory or of practice will help.In this paper, in addition to the introduction and conclusion, the main structure of three parts.
