【摘要】 随着我国核电市场的快速发展,国内外核电建造企业间的竞争愈演愈烈,如何在激烈复杂的市场竞争中立于不败之地和抢占先机,核电建造企业除了做好技术的创新、人才的储备、市场的开拓外,保护好企业商业技术秘密同样是企业核心竞争力的有效体现。本文通过对商业秘密的概念、基本特征、构成要件、现状、必要性和发达国家商业秘密的发展情况进行描述以及对我国商业秘密保护这一领域现状必要性和面临的形势进行分析,提出进行商业技术秘密保护的意义。主要围绕以中国核工业建设集团公司为代表的核电建造企业商业技术秘密保护的问题,分析在我国核电大发展以及核电“走出去”的大背景下,商业技术秘密保护的现状,研究如何进一步做好核电建造企业的商业技术秘密保护问题,如何进一步提高企业员工的商业技术秘密保护的意识,建立健全商业技术秘密管理机制,从而在核电建造企业的层面研究制定完善的商业技术秘密保护法规体系和商业技术秘密风险防范机制,提出核电建造企业商业技术秘密保护的措施及建议以及有效的方法,初步形成中国核工业建设集团公司商业技术秘密保护的基本管理体系,以期对核电建造企业商业技术秘密保护的进一步完善献出微薄之力。更多还原

【Abstract】 With fast development of nuclear power in China, the competition between domestic and foreign NPP constructors are becoming increasingly severe. As a result, how to remain invincible and seize opportunity in complex market competition? Apart from technical innovation, talents reserve and market development, the well protection of enterprise’s commercial and technical secrets also reflects the core competition of a company.The paper describes the concept, essential feature, key component, status quo, necessity of commercial secret, also the development of commercial secret in developed country and analyses the situation and necessity to protect commercial secret, finally reveals the significance of commercial and technical secret protection. Starting from the secret protection issue of NPP constructors represented by CNEC, the paper analyses in the context of nuclear power development in a large scale and nuclear power go global, the status quo of commercial and technical protection, research on how to protect NPP constructor’s commercial and technical secrets, how to further improve employee’s protection awareness, how to set up a sound management mechanism of commercial and technical secrets, in order to build a complete commercial and technical secrets protection legal system and risk-prevention mechanismby NPP constructors. By proposing the measure, advice and efficient approach on commercial and technical secret protection, the paper aims to form a fundamental management system on CNEC’s commercial and technical protection and contribute to perfect the protection in this regard among NPP constructors.更多还原
