【摘要】 随着我国公共资源交易市场化的推进,为了进一步转变政府职能,整合公共资源交易领域职权关系,提高公共资源利用效率,建立起公共资源中心这种规范统一的交易平台并有效发挥其职能成为当前全国各地紧迫的任务。本文首先从公共资源、公共资源交易中心等概念出发,对公共资源交易中心职能进行归纳总结,结合委托代理理论、决策与执行分离理论、权力制衡理论等理论,明确其在公共资源交易中的职能作用。其次,系统阐述了我国公共资源交易中心发挥职能时存在诸如独立性不足、与政府服务职能交叉、违规发挥职能等方面问题。再次,本文从管理学、行政学、法学等多学科角度重点深入分析了公共资源交易中心发挥职能时存在问题的原因。为了明确公共资源交易中心职能以进一步实现其在公共资源交易中的职能作用,我国需要积极学习借鉴美国、德国、日本等西方国家在公共资源交易市场化建设的先进经验,同时学习国内先进省市公共资源交易中心发挥职能的先进做法,坚持市场法治原则、权力制衡原则、公开公正原则、创新体制原则,探索出适合我国公共资源交易中心发展的职能实现路径。最后,本文提出了以下几方面的建议思考：迫切需要从法律上明确公共资源交易中心的职能；加快公共资源交易中心管理体制改革；推进电子信息平台建设；强化政府部门、服务对象、社会对公共资源交易中心的全方位监管；从思想和技能上提高工作人员素质,以期促进公共资源交易中心职能的良性发挥。更多还原

【Abstract】 The market is supposed to play a decisive role in the allocation of resources while government perform its function better to adjust in.Along with the advancement of public resources trading market in China, in order to transform government functions further, integrate of public resources trading function and power, improve the utilization efficiency of public resources.Establishing the public resource center as well as giving its function to full play becomes the urgent task throughout the country.Firstly,this passage starts with a few fundamental concepts such as Public Resource,Public Resource Trading Center,Function,then summarize all the expected functions of public trading center based on a few famous theory.What’s more,we systematically analyze that there are many problems when public resource center perform its functions.Next,this passage mainly explores profound reasons which leads to those problems we have listed under the guidance from multiple disciplines vary from Politics to Laws.Therefore, in order to optimize public resources trading center to further develop its huge role in the public resources trading,we are expected to actively learn from western countries’advanced experience in the field of public resources trading such as America, Germany, Japan.According to China’s specific national conditions,we need to explore suitable realization path for the development of China’s public resources trading center function. This paper tentatively puts forward a proposal with the following several aspects:There is an urgent need to legally define the function of public resources trading center; We should reform management system of the public resources trading center; Accelerating construction of informational trading platform; Strengthening the supervision from government departments, market entities, the public; Improving quality of staff mentally but also physically, to better play the role of public resources trading center.更多还原
