【摘要】 在当今世界,行政权应当通过某种恰当的方式加以限制,几乎已经成为世界上所有文明开化国家的共识。事实上,自“行政权”诞生之日起,人类社会便从未停止过对行政权限制与规范的探索脚步。从历史的角度看,行政权限制的理论发展和实践,是伴随着人类社会的发展而不断展开的。行政权限制的发展,始终有着理论与实践两条脉络,沿着这两条发展线索,我们可以清晰地把握到行政权限制的发展脉络。与此同时,在行政权限制的理论与实践发展过程中,政治家和学者逐渐总结出了行政权限制的四种基本方式,即以权力限制行政权、以权利限制行政权、以道德限制行政权和以法律限制行政权。这四种方式均曾对行政权的限制起到过重要的作用,但在行政权日益膨胀的21世纪,单纯凭借四种方式中的哪一种都无法在保证行政权不被滥用的情况下又实现其高效运转,在这种情况下,权力清单制度应运而生。经由权力清单限制行政权行使兼具了合法性、必要性与可行性,既符合了行政合法性、行政合理性和行政公开性三项原则,又对依法治国和行政体制改革做出了积极回应。在此基础上地方各级人民政府推行权力清单制度的实践,也为权力清单制度的发展、完善与成熟提供了宝贵的经验。从确保权力清单推行法制化、体系化、规范化和科学化的角度讲,权力清单的设置要坚持职权法定、上下联动和动静平衡的原则,要以不影响行政权的正常行使为基本限度,在此基础上要按照清权、确权、配权、晒权和制权的步骤实现权力清单制度的流程化构建。更多还原

【Abstract】 At present, it has been a consensus of civilized countries that the executive power should be restricted in a certain way. In fact, human society has never stopped exploring ’how to restrict’ the power since it was born. Historically, the theoretical development and practice of the executive power restriction has been evolved with the development of human society. The development of the executive power restriction has two contexts-theory and practice, along which, we can clearly hold the developing vein of it. In the process of theoretical and practical development for executive power restriction, the politicians and scholars gradually summarized four ways to limit the executive power, that is, using the authority, right and benefits, morality and law to restrict. All the four ways played an important part in restriction to the executive power, but in the 21st century that executive power is increasing inflated, it is impossible to achieve its efficient functioning without abusive executing the executive power if only depends on one of the four ways.Therefore,the power list emerged at the right moment.Exercise of the executive power integrates the legality, necessity and feasibility into one via the power list, which not only conforms to principles of administration legality, administration rationality and administrative publicity but also gives an active response to law-based governance and administrative reform. Local governments at all levels promote the practice of the power list system, which offers good experience for the system development and improvement. The setup of the power list shall adhere to the such principles that authorities must abide by the law, the central government and the basic level coordinate and the establishment of mechanism and corresponding practice must balance, meanwhile, take the normal exercise without interrupting the power as the limit, then achieve a routing construction to the power list according to procedures of cancelling, clarifying, opening and managing the power.更多还原
