论企业的人权责任

【摘要】 当今时代是个权利化时代,人们的权利意识得到了很大的提高,作为与人们权利息息相关的经济组织,企业责任的重要性开始凸显,尤其是在经济全球化的背景之下。跨国企业数量的逐年增多以及其经营活动的跨国性决定了其影响的全球性。作为经济发展的产物,企业社会责任的范围也随着经济社会的不断发展而逐渐扩大。作为其核心内容的企业人权责任的重要性也开始凸显。研究企业的人权责任具有非常重要的理论意义和实践意义。企业人权责任是随着经济社会的不断发展而逐渐从企业社会责任中独立出来的,故而,对企业人权责任的理解必须建立在研究企业社会责任的基础之上,在比较和分析中对相关概念进行界定。当前,无论是理论层面还是实践层面,均存在一系列的问题限制着企业人权责任的实现。在理论层面主要体现在三方面:第一,企业人权责任没有被提高到人权的高度予以重视;第二,立法实践和企业人权责任理论严重脱节;第三,企业、个人的人权意识缺乏。实践层面的困境体现在两方面:第一,无论是硬法、软法、自律机制还是社会监督机制都存在一系列弊端需要改善;第二,在经济全球化背景下,随着跨国企业数量的增加和规模的扩大,法律适用上的问题也凸显出来,新的规制路径成为迫切需要。对企业人权责任进行研究是对当前企业人权责任理论困境的一种回应,便于更好的定义企业的社会责任,认清企业社会责任中人权责任的属性,进而提高企业人权责任的规制高度,也是对当前人权责任主体范围的一种突破。研究企业人权责任有助于实现对人权的全方位保障,有利于企业人权文化氛围的营造和人权意识水平的提高,为规范企业人权责任开辟出新的路径。研究企业人权责任,有助于帮助我们界定企业人权责任的内容范围,督促企业承担人权责任,减少侵权现象的发生。在立法层面,研究和分析企业人权责任,有助于帮助我们解决立法中的实践难题,促进国际国内的相关立法,加快立法进程,为企业人权责任提供法律依据,并有效规制企业的侵权行为。在司法层面,有助于解决当前各国面临的司法争议难题,确保有法可依,实现公正司法,维护国际国内的社会秩序。本文主要包含四章内容:第一章是在对企业社会责任和企业人权责任的比较和分析的基础上对企业人权责任进行界定;第二章是论述企业人权责任的正当性;第三章是分析企业人权责任当前面临的理论难题和实践难题;第四章是为规范企业人权责任开辟出新的规制路径。

【Abstract】 Present era is the era of rights, people’s awareness of their rights has got a general increase. As economic organizations that closely linked with people’s rights, the importance of corporate responsibility are more and more obvious, especially in the background of economic globalization, The number of multinational enterprises are increasing year by year, The global scope of business activities of multinational enterprises also determines its global influence. As a product of economic development, the contents of corporate social responsibility are more and more widely with the continuous development of economy and society, As its core content, the importance of corporate responsibility for human rights also emerged. Studying on corporate responsibility for human rights has very important theoretical and practical significance.Corporate responsibility for human rights is not an independently generated conception, it is separated from the corporate social responsibility out with the development of the social and economic, therefore, The study on corporate responsibility for human rights must be established on the basis of corporate social responsibility, and to define relevant conceptions in comparison and analysis between them. At present, whether theoretical or practical level, there are a series of problems limit the realization of corporate responsibility for human rights, There are three aspects in theoretical level:First, corporate responsibility for human rights is not be raised to the level of human rights to given appropriate attention to; Second, legislative practice and the theory of corporate responsibility for human rights are out of touch; Third, both the corporate and individual’s awareness of human rights is in lack. The dilemma in practical level is mainly reflected in three aspects:First, there are all sorts of shortcomings that difficult to overcome, Whether hard law, soft law or self-regulatory mechanisms and social oversight exist many deficiencies need to improve; Second, under the background of economic globalization, with the increasing number of multinational enterprises and the expansion of scale of multinational enterprises, difficulties increasingly prominent in the application of law, new regulatory approaches are in big demands.Studying on corporate responsibility for human rights is making a response to the theoretical dilemma that faced by corporate responsibility for human rights, this helps to define the scope of corporate responsibility for human rights in a better way, to recognize the property of human rights in corporate social Responsibility, And thus raise the level of regulation of corporate responsibility for human rights, but also a breakthrough in the limitations of subject range of human rights obligations. Studying on corporate responsibility for human rights also contribute further to achieve full protection of human rights, helping to promote the building of enterprise culture of human rights and enhance their personal sense of human rights, providing a theoretical basis for corporate to take responsibility for human rights, also open up new paths for corporate to take responsibility for human rights and regulatory way.Studying on corporate responsibility for human rights, we can define the scope of corporate responsibility for human rights, and urge corporate to consciously assume responsibility and reduce human rights violations. At the legislative level, studying and discussing on corporate responsibility for human rights can help to resolve the practical problems, to promote domestic and international legislation, accelerate the pace of legislation, thus providing a legal basis for corporate to take responsibility for human rights, and to regulate corporate’s conducts in human rights violations. At the judicial level, this helps to solve the problem of jurisdictional disputes that faced by national jurisdictions, to ensure that the judiciary can get the law to follow, then to achieve a fair judge, to address human rights disputes and maintain international and domestic social order.This article includes four chapters:The first chapter is to define the conception of corporate responsibility for human rights on the basis of comparison between corporate social responsibility and corporate responsibility for human rights; The second chapter demonstrates the legitimacy of corporate responsibility for human rights; The third chapter is to analysis those theory and practice regulatory problems in corporate responsibility for human rights; The fourth chapter is to open up new regulatory paths against the dilemma exists today.
